MANILA, Philippines—Buried on page 8 of the Supreme Court’s 97-page ruling that voided the impeachment of Vice President Sara Duterte is a line that has set off confusion, debate, and calls for accountability.

“At 4:47 p.m. of February 5, 2025, House Secretary Velasco transmitted the Articles of Impeachment to the Senate even without a plenary vote,” the ponencia penned by Senior Associate Justice Marvic Leonen stated, citing ABS-CBN reports as its source.

00:00Impeachment complaints were referred to the Comedian rules and were consigned to the archives on February 6, not February 5, as claimed in page 78 of the decision.
00:18Nag-housekeeping lang ang house, kaya in-archive, hindi to end the Congress.
00:25This archiving were not the results of the ending of the 19th Congress, but because of the fact that the 4th complaint were already filed and transmitted to the Senate.
00:43E dito pa lang, Mr. President, pilit na pilit na patunayan na barred ang 4th complaint.
00:48Kapag ayaw, may dahilan. Kapag gusto, may paraan.
00:55Now, to continue, Mr. President, and this is very much related.
01:04The Supreme Court, by the way, if it is wrong, if the complaint done by the House of Representatives was wrong, we cannot correct a wrong with another wrong.
01:24The Supreme Court, essentially, amended the Constitution by removing the third mode of filing of impeachment complaint.
01:35This third and speedy mode was enshrined there for a reason.
01:47In times that there is an urgent need to impeach a person who is influential and powerful and may use his position to evade the law,
01:58The third mode, which is the third mode, which is the fastest way, was provided in the Constitution.
02:06Why don't you ask the authors of this provision in the Constitution?
02:13So, Mr. President, continuing, if the Supreme Court is now changing the meaning of initiating, then at the very least, please apply it prospectively.
02:43However, they are applying this new ruling retroactively, which is a violation of the doctrine of operative facts.
02:52Kung ganito kanilang kagustuhan, ano, at susundin natin, basta-basta,
02:59Apektado din dito yung nakarang impeachment.
03:02The impeachment proceedings.
03:03In the words of retired Supreme Court Senior Justice, Antonio Carpio, I quote,
03:12The said Supreme Court decision practically voided the impeachment proceedings against former President Joseph Estrada and former Chief Justice Renato Corona.
03:26Pag gusto talaga, may paraan.
03:32Pag may, pag-ayaw, may dahilan.
03:35Pero huwag naman sana pati sa mga nitong bagay that will ultimately affect future impeachment and legislative rules and proceedings.
03:45Sa atin yun eh.
03:48I've read that the basis for the retroactive application of the new definitions because the Senate now has not acquired jurisdiction yet.
04:01Eh, Mr. President, ano tawag natin doon sa nag-constitute kayo as an impeachment court?
04:08Nag-robe pa kayo?
04:09So, he even sent out summons.
04:13Ano yun?
04:14June 9, the Senate President took his oath.
04:19June 10, nag-convene ng impeachment court.
04:23Ni-remand to the House of Representatives.
04:29Tapos yung issue of the summons.
04:39To the defense.
04:46Eh, ano po tawag doon?
04:47Hindi nag-convene?
04:50Baka hindi na balitaan ng Supreme Court na hindi nag-convene.
04:55Kaya naisabi nila yan.
04:57So, now, just an observation.
05:00I will try to shorten this, Mr. President.
05:05Just an observation, Mr. President.
05:09Well, not only myself, but several lawyers mentioned this to me, including my godson, former Senate President, Aquilino Pimentel III.
05:21Naguluhan sila sa pagkakasulat doon decision.
05:24It is incoherent and some parts are off topic, sabi nila.
05:29Para bang pinagtagpi-tagpi, basahin nyo mabuti.
05:32Uli, ang damang gagaling na mga abogado rito, basahin nyo.
05:34It even quoted the entire Article 11 of the Constitution, not only once, but twice.
05:44It seems there were two ponentes.
05:47Parang na nila ba author dito?
05:50Well, that is there in my observations.
05:54Just an observation.
05:55So, Mr. President, the personalities in this present impeachment case is of no moment to me.
06:02The vice president is a friend of mine.
06:05The former president, President Duterte, has been my friend since 1988.
06:11Everybody knows that.
06:13What I'm pointing out is the danger of outright dismissing the impeachment proceedings
06:20by virtue of a decision that is not yet final and still pending appeal.
06:29Justice Leaudet himself said, Mr. President, I quote,
06:34The Supreme Court is not perfect.
06:36Citizens and academics certainly have the right to call attention to the fallibility of the courts.
06:43Tama po yun.
06:44There is no perfect institution.
06:46Even Supreme Court ka, pwede mag-commit ng grave abuse of discretion
06:51or culpable violation of the Constitution.
06:57A case decided unanimously does not mean that it is infallible.
07:04For all we know, it is a unanimous mistake.
07:07That, again, can be corrected by setting aside and reversing prior...

07:21spy on competitors, and more.
07:24Impressed?
07:25Explore all Simrush toolkits and get what you need to grow.
07:28The motion of the AMR, please let us allow and give chance to the Supreme Court to rectify its decision
07:36which contains clear and blatant errors for their sake and for the sake of future proceedings.
07:46Let us not dismiss forthwith.
07:51And in that light, considering the motion of the gentleman to motion to dismiss,
07:58I move to table the motion to dismiss.
08:02A motion to table is a higher precedence than a motion to dismiss.
08:06Thank you, Mr. President.
08:09Mr. President, may I have a quick reaction to the manifestation of the gentleman?
08:14The gentleman may do so if he so desires.
08:18Mr. President, in the answer of this illusitor general on behalf of the House of Representatives,
08:24there was already a categorical admission that the three initial complaints prior to the fourth one were dismissed
08:34because they were all archived.
08:37As I have said, archiving is not part of the rules of impeachment of the House of Representatives,
08:43but they just did it.
08:45Palusot lamang po yun, Mr. President.
08:49Paano mo i-archive nang hindi mo susundin yung tatlong steps na sinasabi ng sarili nilang tuntunin?
08:57These are not baby steps.
09:00These are constitutional steps.
09:03At kanina po ipinakita yung slides na yung inclusion in the 10th session day is constitutional.
09:09The referral to an appropriate committee is constitutional.
09:15There was no referral to any committee.
09:18Ang ginawa po nila itin-ransmit nila sa Senate.
