00:00Ms. Nielsen, you say the birth of your two-year-old son, Caden, literally saved your life.
00:08And to repay him, it is imperative that you make it a point to have his daddy in his life.
00:14So you've summoned the defendant, Mr. Davis, to court to prove to him that he is your baby's
00:19biological father. Is that correct?
00:21Yes, Your Honor.
00:22Mr. Davis, you claim it is commendable that Ms. Nielsen has changed her life, but unfortunately,
00:27she cannot undo her past. You are 100% certain that you are not her son's father and claim to
00:34have physical proof to support your doubt. Is that correct?
00:38Yes, Your Honor.
00:39So, Ms. Nielsen, how did Caden save your life?
00:43I struggled with an addiction for numerous years. And when I found out I was pregnant with Caden,
00:49I was able to go into rehab and stay in rehab until I had Caden. And I still today am clean
00:57from the time I was pregnant. So I'll have three years clean in September.
01:02That's wonderful. That is wonderful.
01:06And so this child really did change your life in more ways than one.
01:11He saved my life.
01:12And so you believe Mr. Davis is Caden's biological father.
01:17Yes, I believe he is.
01:18Tell me why.
01:19When I found out I was pregnant, I went into rehab in the past few months before I went into rehab.
01:26I spent a lot of times with Mr. Davis. I actually stayed at his cousin's house and he was with me
01:33almost every night at his cousin's house. So we were together for a few months before I went into rehab.
01:40You all were having a sexual relationship and presumably not using protection.
01:45Yes.
01:45Mr. Davis, do you remember this relationship?
01:48Yes, I do, Your Honor.
01:50It was not a relationship. It was just something I was just trying... I was just pursuing.
01:54We were just having sex. We just wasn't... I was already in a relationship.
01:59Oh. All right. So you were in a relationship, but you were having a sexual relationship with Ms. Nielsen.
02:05Exactly.
02:06But were you using protection?
02:08No.
02:08All right. So that is what lands you in paternity court.
02:15Uh, moving on. So you having a sexual relationship with her.
02:20She says it's during the window of time that she conceived.
02:23Well, see, I don't know about that because when I first met Ms. Nielsen, we were both in a place where we was trying to get our life together.
02:29At that time, I used to tell her that she was pregnant then, but she said she wasn't.
02:35So after we left that place, that's when we stopped pursuing each other a little bit more.
02:40So when she did tell me that she was pregnant, I told her, you know, what are you telling me for?
02:45Because I knew that you had been with other guys.
02:48Oh, you felt like when you started a sexual relationship with her, she was already pregnant.
02:55Yes.
02:56And you said that to her.
02:57Yes.
02:57Did he tell you that, Ms. Nielsen? I think you're pregnant already?
03:01We met in October of 2012.
03:03I got pregnant in May of 2013 and had the baby February of 2014.
03:11So I was not pregnant when we met.
03:13So, Ms. Nielsen, when you told him you were pregnant, what happened?
03:16So his phone number changed, so I really didn't know how to get a hold of him.
03:19So you didn't speak to him much while you were pregnant?
03:22No, until Kaden was a few months old, I got a hold of him, and he denied it.
03:26So you spent the entire pregnancy by yourself?
03:29Yes, but I honestly, in my heart, I believe that Mr. Davis is Kaden's father.
03:35Because of the lifestyle I was living, supporting my drug habit, there were other people I had sexual relations with.
03:42So what makes you think that?
03:43But I was very cautious with those people, and it was a lifestyle supporting my drug habit.
03:49So what makes you think that I was the father doing it?
03:52Because we didn't use protection, and we were together.
03:54And you used protection?
03:55Compared to one time with these other men to multiple times with you.
03:58Because I saw you, you know, I saw you with other guys.
04:00Yeah, you were there.
04:02Physically, physically.
04:02I know that.
04:04You saw her, what do you mean you saw her physically?
04:06Physically with other guys.
04:07We was at a place, and she brought other guys into the place and told me to leave out.
04:12And you were still having sex with her with no protection?
04:15Yes, that was my, yes.
04:17Because the money, it was all about the money and using.
04:20We were both, had a different lifestyle at that time.
04:22Understood, understood.
04:24So in your mind, Ms. Nielsen, did you feel like this thing, this sexual relationship with Mr. Davis could turn into something?
04:32Did you feel like maybe there was a chance for a relationship there?
04:37Yeah, honestly, I did.
04:38I had feelings for Mr. Davis, and he was well aware of that.
04:41He was playing me, obviously, because we said we loved each other.
04:45He would tell me to think, yes, you did.
04:45I've never told you that.
04:47And we would talk on the phone.
04:49I was in a different city.
04:50I have never told you that.
04:51I would travel on the train to come spend time with him.
04:54There was a time we talked about getting a place and being together.
04:56Negative.
04:57There was a time we talked about.
04:59We never talked about anything, but...
05:01But I honestly, I didn't know if he was real.
05:04I knew about his other life, so...
05:06You know, I never had feelings for you.
05:07Now I know that.
05:08Mr. Davis, you're having sex with this woman for a course of months.
05:13Yes, Your Honor.
05:14And you admit you're not using protection.
05:16Yes.
05:16Now, okay, if you told her you don't really have feelings for her, so be it.
05:20I can't change that.
05:22But you have to understand that you are most certainly a possibility
05:26if the window of conception matches up to the time you're in a sexual relationship with her.
05:31I know it was other people involved that could also be the father.
05:35Understood.
05:36Your Honor.
05:37Yes.
05:37I have a birth certificate, and he has a last name of H.
05:42I mean...
05:43Let me see that, please, Ron.
05:44This is evidence...
05:46This is a birth certificate, you said?
05:48Yes.
05:48This is a copy of Caden's birth certificate?
05:51When you look at the last name, you don't see yours.
05:54Exactly.
05:55So you see...
05:55Nor hers.
05:56Or hers.
05:58Exactly.
06:14I didn't have any friends or family by my side.
06:17My whole lifestyle I let go of, because it's in the past.
06:20The one man that is by my side is incarcerated.
06:23We communicate correspondence mail and on the phone calls, and he will always be in my life.
06:29He will be out next year, and if he will be...
06:31If he's in my life, he's in Caden's life.
06:33So you gave Caden just a friend's last name.
06:39Yes.
06:40But he's a good man, and I believe he will be there for my son if no one else is.
06:44All right.
06:45And listen, you had gone through a very traumatic evolution, we'll say.
06:51And I understand that.
06:53But what we're here discussing is Caden's paternity.
06:57And so as we talk about Mr. Davis' doubt, we have to understand that, yes, that now a
07:05birth certificate with another man's last name on it gives him even more reason to doubt.
07:11It's another guy that says that he's most definitely the father that she's claiming.
07:15Oh, so there's another gentleman claiming that he's Caden's biological father?
07:21Yes, Your Honor.
07:21So that's Mr. Turner.
07:23Yes.
07:24He's in court today in the hallway.
07:26That's the other gentleman he's talking about.
07:29I met Mr. Turner years back.
07:31We also partied and had that lifestyle together.
07:34It was pretty much a relationship out of convenience.
07:37I honestly do not remember at the time of conception being with this man.
07:41I remember telling him I was pregnant, just in general, telling him, oh, my gosh, I'm pregnant.
07:46I really need to get my life together and I need to do something because I'm still using
07:50and I found out I was pregnant.
07:52And he supported me, you know, going to rehab and was very encouraging.
07:55He says he's Caden's biological father.
07:59Yeah, I haven't seen him in years.
08:00And six months ago, he says he's turning his life around and shows up in the city where
08:05I live.
08:05And he says he wants to see Caden.
08:08And I mean, he's...
08:09But Mr. Davis is saying his doubt stems from the fact that he knows you haven't sex with
08:14other people during the window of conception and that Mr. Turner is claiming the baby
08:19is his.
08:20Yes, Your Honor.
08:21And I...
08:21That would make the average man doubtful.
08:23Yes.
08:23I want to hear from him.
08:24Ron, will you please escort Mr. Turner in the courtroom, please?
08:27Yes, ma'am.
08:27Hello, Mr. Turner.
08:32Thank you for joining us today.
08:34You're welcome.
08:34Hello, Your Honor.
08:35We're here discussing the paternity as it relates to baby Caden.
08:39And I'd like to know why you believe you are Caden's biological father.
08:43I had known about her, you know, her pregnancy.
08:46And I had...
08:47I moved away.
08:48And then I lost contact with my phone's information.
08:51So my daughter set up a Facebook page for me.
08:54And she...
08:55She friend requested me and seen me.
08:57And then when I seen Caden, I looked at him and I said, wow.
09:01I say, he really looks like my other son.
09:04I believe that he was my child.
09:05He looked...
09:06To me, he looked like me.
09:07He...
09:07I got a guy between my teeth.
09:09He got a guy between his teeth.
09:10He has a lot of characteristics.
09:12Similar, he acts...
09:14He acts like...
09:15He acts like all my children, you know.
09:18And you admittedly were in a sexual relationship with Ms. Nielsen
09:22during the window of time Caden was conceived.
09:25Yes, Your Honor.
09:26You acknowledge that as well, Ms. Nielsen?
09:28I honestly don't remember.
09:30I remember we had a relationship pure out of convenience.
09:35And I was around him at that time.
09:37Okay.
09:39What is your involvement with Caden now, Mr. Turner?
09:41Once she contacted me on Facebook, I made arrangements to come out and see, you know, see him.
09:48So he likes to go to parks and he likes to run.
09:50So we run, you know, he reruns and I'm like, it's an all-day affair.
09:55We go out and we eat.
09:56I've been, you know, I've been on several, you know, been on several visits, you know, to see him.
10:02They were all good, you know.
10:04To me, I thought they were all good.
10:05Now, did you let him spend time with Caden because you believe he is one of Caden's possible biological fathers?
10:12I've told him from day one that I believe that Mr. Davis is his father.
10:16Mr. Turner, has she ever told you, Ms. Nielsen ever told you that you are Caden's biological father?
10:22She told me that she had doubts.
10:24She didn't, she said she did not know.
10:27So when she introduced you to Caden, how did she introduce you?
10:31This is my mommy's friend?
10:33How did she introduce you?
10:34She didn't, she didn't introduce me as, as dad.
10:37And, um, for that reason, you know, I never pushed, I never pushed the issue because I said before I wanted him to call me dad.
10:46I wanted to know if I was his true father.
10:48And have you been providing for Caden?
10:51I've, I've tried to make attempts to provide for him.
10:54He's not doing anything.
10:55Nobody has been there.
10:56Nobody has bought Caden a pack of diapers, a sippy cup, a toy, a train, nobody even knows what he likes.
11:03You couldn't even, he couldn't tell you anything about Caden.
11:05Your Honor.
11:05He says he knows Caden.
11:06Your Honor.
11:06So you feel like you're all by yourself.
11:08Three times.
11:09I am all by myself and maybe I put myself in that position.
11:12But if I could possibly prove who Caden's father is, which in my heart I believe is Mr. Davis, I would like to do so.
11:18Mr. Turner has not provided.
11:20He has offered to provide.
11:22Every time he gets paid three separate instances, he offers to bring pull-ups.
11:27Then for two days, his phone does, his phone's lost or he doesn't answer his phone and he does not show up.
11:33I've told Caden, DT's coming.
11:35He does like DT because DT plays with him and takes him, you know, he remembers that time because he did play one-on-one attention.
11:43Any kid would like that.
11:44And he doesn't come and then Caden's going in the door all day, DT, and he's not there.
11:49See, that's the whole point.
11:50She looks for me.
11:51She talks about nobody's there for her and she looks for support.
11:54Basically, I would like to prove to Mr. Turner that Caden is not his phone.
11:57One at a time.
11:59What I'm not understanding is you seem to be angry with Mr. Turner because he is being irresponsible as it relates to bringing the pull-ups and doing what he says.
12:08But you said that you truly believe with all your heart Mr. Davis is Caden's biological father.
12:14So why are you mad at him at all?
12:16I'm mad because he presented the situation.
12:18I would be mad at anyone if they said we're coming over tonight for dinner and they don't show up.
12:22So you're angry because he makes promises he doesn't keep.
12:26And he doesn't keep.
12:27All right.
12:28Mr. Davis, why are you so doubtful?
12:30Well, she told me she was pregnant and by me knowing her lifestyle and what she was capable of doing and me seeing her with other guys physically,
12:38I knew that it could also be someone else that could be the father.
12:42Okay, so you doubted because you knew she was having a sexual relationship with someone else as well.
12:46Right.
12:46But you did know that you were also having a sexual relationship with her.
12:51What else?
12:53Any other reason to doubt?
12:54He doesn't really look like me in any kind of way.
12:57You don't feel like the child looks like you?
12:59Not, no.
13:00I think he looks like he could be another nationality.
13:04You think the child's another nationality?
13:06Yes.
13:06Well, Ms. Nielsen is another nationality.
13:09Maybe he's a blend of two.
13:11Of Mexican as well.
13:13I honestly believe that he is Kayden's father.
13:16And I don't have much family.
13:18I only have a mother.
13:19I've never had a big family growing up.
13:22And that always, I feel like, I kind of, I always wish I had a family.
13:28So if I could find a family that is, in fact, Kayden's and they could do right by him, I would like to provide that for him.
13:35All right.
13:40At this point, I've heard enough testimony.
13:42And there definitely is doubt here.
13:44And Ms. Nielsen, it's time to get the answers for you and Kayden.
13:48Thank you, Your Honor.
13:49I'm ready for the results, Ron.
13:51Yes, ma'am.
13:54These results were prepared by DNA Diagnostics, and they read as follows.
13:59In the case of Nielsen versus Davis, when it comes to two-year-old Kayden, it has been determined by this court, the biological father is Mr. Davis.
14:29Yes.
14:33All right.
14:35Okay.
14:36How do you feel?
14:38I feel good.
14:39So now my sons can know they little brother.
14:41Good.
14:42Good.
14:43That's what we want to hear.
14:45And I see, Ms. Nielsen, that you have tears in your eyes in this moment.
14:49What are you feeling?
14:51Mixed emotions.
14:52I'm happy to finally know, but I'm scared for Kayden.
14:55And I'm scared for his future, because I want him to have a good father.
15:00And I want him to have a good life and have everything he deserves.
15:05And I just really want you to step up and be there, Rodney.
15:08Please, he needs you.
15:09He needs you more than any child needs a father.
15:12Ms. Fleming, you are suing the defendant for fraudulent misrepresentation because you say she deceived you and your son, Calvin, into believing her daughter, Alina, is his child.
15:26You've petitioned the court for a paternity test and are asking the court to award you $500 in expenses.
15:34Ms. Jemison, you admit you slept with another man around the time of conception, but you are certain Ms. Fleming is your child's grandmother.
15:42Yes, Your Honor.
15:43Ms. Fleming, why is it so important for you to get a DNA test done today?
15:48Your Honor, it's so important to me, first of all, because I love Adriana and I love Alina.
15:53I love Alina with all my heart and we want to, my family needs to know, we need to know the truth.
16:00My son has asked me several times, he explains that he does not want his family to not be certain, so that is why we're here today.
16:09And there have been several things that have taken place and Calvin needs to have this test.
16:16He's written me letters saying that he wants to know.
16:19So I have proof here.
16:20I would like to see that proof.
16:21Jerome, will you hand me the evidence, please?
16:24And this is...
16:26That's a letter from him, Your Honor, that he sent me last month stating that he wants to have this test taken.
16:31So it is not just me.
16:33The letter reads,
16:33I want a DNA test as soon as possible because I love Alina to death and I really don't want this to get any deeper than it already is.
16:42So if there's any way I can get it done, I would really appreciate that.
16:47Yes, Your Honor.
16:48So he is unable to have the DNA test now?
16:52Yes, ma'am, he's unable.
16:53Because he's in jail, he's incarcerated.
16:55Yes, he's incarcerated.
16:56And so we were able to perform a grandparentage test?
17:01Yes.
17:01To be able to get you some answers today.
17:06So what is your relationship with Alina right now?
17:10When all of this stuff first came out, when I found out that my son could possibly be having a child, I wasn't certain.
17:17Adriana was very honest about the fact that she wasn't 100% sure.
17:20So we kept our distance, but as we've gone through and she's here and she's born and we've had reason to believe that she is ours, I've spent time with her and gotten very close to her and I do love her.
17:31And so, Ms. Jemison...
17:32Yes, Your Honor.
17:33Do you believe there is reason to doubt at all?
17:36Yes, Your Honor, I do believe that there's reason to doubt.
17:37Well, please tell the court about that.
17:39I was with somebody else.
17:41The other guy was a one-time thing.
17:43Calvin was basically staying with me.
17:45You really believe Calvin is the father?
17:48Yes, Your Honor.
17:49I really believe that he's the father.
17:51There's no doubt in my mind that he's not the father of Alina at all.
17:55And I know because my daughter was born with a six-digit and that the extra digit is genetically passed from the father's side of the family.
18:05Your Honor, I'm a nurse and I know that it can't just be on one side of the family.
18:10His grandmother, my son's grandmother is a female and if she passed the gene on to her family,
18:15how can it only be passed by a male?
18:17I know that there's, it cannot just be passed on one side.
18:20There's also other reason with the extra digit for me to believe that this may possibly not be a genetic trait from my son
18:27because we were in the delivery room when Adriana was having the baby.
18:32And one of her family members says to me, mentions that she has a sibling that has the same, that was born with the same thing.
18:40But he was, he has a separate father. Me and my brother do not share the same father.
18:45He has his only father.
18:45So what you found out, you, that there was a sibling that also had a sixth digit.
18:50Yes.
18:50And so that then fueled your doubt more.
18:54Yes, it did. It was a whole different her after she heard that from them.
18:58And so when you initially heard about this sixth digit, that made you believe that the child was your son.
19:08Absolutely. And I...
19:09Because you knew that was a family trait.
19:11Yes. And I allowed myself to feel wholeheartedly.
19:14And I did not restrain my feelings from that point on because I felt like this was my granddaughter.
19:18So that was your moment where you said, this is his son.
19:22Yes.
19:22I'm this child's grandmother.
19:23Absolutely.
19:24Let me jump in.
19:25Yes.
19:26Let me get involved.
19:28Right. Because my son wasn't there.
19:30So I felt like I had to be there for her because he's not available.
19:33That is admirable.
19:38And, Your Honor, I have evidence here.
19:39I was very excited about the baby.
19:41I brought on her cake for the shower.
19:43I put, I can't wait to meet you, Alina.
19:45I'd like to see that evidence.
19:46I was very excited that she was coming.
19:47She was excited.
19:49I'm not saying that she wasn't, but...
19:51And you were truly excited?
19:52Yes, absolutely.
19:53You were going to be a grandmother?
19:55Yes.
19:56You heard about this trait.
19:57You said, okay, this is my son's child.
19:59Yes, but there's more traits that leads to it's his daughter.
20:02She's born with a lazy eye.
20:04My daughter has a lazy eye.
20:06And I did notice a while ago that Natasha had a lazy eye and the same exact eye.
20:11And it's the same thing.
20:12And my daughter was born with dimples.
20:14His grandmother has dimples.
20:16I don't have dimples, but I don't know where the dimples come from.
20:19Right, I don't know where...
20:20But his grandma was born with dimples.
20:22The other guy don't have dimples.
20:24He don't have an extra digit.
20:25He don't have any of that.
20:26It's more that leads to Calvin.
20:28My daughter is very long.
20:30Calvin is very long and very tall.
20:32She's very light-skinned.
20:33I am light-skinned, but I'm not as light as how my daughter is.
20:37Beautiful little girl.
20:39So I just know that that's his baby.
20:41And with the six digit, I asked the other guy about it.
20:45He told me if something's wrong with your baby, that don't run in my family.
20:48Once I heard that, I just called Calvin and I asked him.
20:51I said, does anybody in your family have an extra digit?
20:54He says, yes.
20:55Then later on in the evening, his mom called and said, your grandma has the same exact digit.
21:00And the same exact hand in the same exact spot.
21:03Really?
21:03That's exactly where her extra digit is.
21:05Same exact hand, same exact spot.
21:07And I've been with Calvin for two years now, on and off, messing around with him.
21:12And I just know that that's his baby.
21:14I don't see the resemblance.
21:17The baby looks just like her mother.
21:18I do. I see the resemblance.
21:19She does look just like me, but she does have features that points to him.
21:23Ms. Living, you brought a witness today.
21:25I'd like to hear from her.
21:26Please stand, ma'am.
21:29State your name.
21:30Markeia Elliott.
21:32Markeia, you are...
21:33His sister.
21:35All right.
21:36And so, ma'am, what do you know about this situation?
21:38Let me first say that me and my brother are the closest out of all of my siblings.
21:43You know, we're only 18 months apart.
21:44So, you know, he was calling me and things of that nature.
21:48And I would come get him and Adriana if he needed me to.
21:51So, I know that he was with her at times.
21:54But I've heard rumors in the beginning, not even from him, saying that, you know, she was loose.
22:00I was not loose. I was not loose. I was single.
22:02I don't know why she's so adamant, because she states herself that she slept with other people.
22:07I slept with one other guy.
22:08Where does that...
22:08Yes, a lot of people, just one other guy.
22:10Okay, it takes one time to make a baby.
22:12Okay, you're right.
22:12You say he didn't want to be with her for specific reasons. What reason?
22:16She did have a boyfriend and she was still dealing with him.
22:18No, me and my ex-boyfriend were long over with before I...
22:20You broke up because of him, too.
22:22I broke up with my boyfriend for Calvin.
22:25Okay, so you were messing with him.
22:26No, but I wasn't messing around with my ex-boyfriend anymore.
22:29It's no way that it's his at all.
22:31I know for a fact, the date of conception, you had sex with someone else,
22:35and he was with other people, she was with other people.
22:37It's just very messy.
22:38So, it was like an open relationship, no commitment.
22:41Yeah, basically.
22:41Both were sleeping with other people.
22:43Yeah, they were best friends.
22:44Yeah, they were friends.
22:44And if she's getting pregnant by her best friend, who knows?
22:47Before all this happened, Markeia knew nothing about me.
22:49She didn't really know me, she just heard hearsay.
22:52I never really conversated with her, and it's still like that to this day,
22:55because it's just tension and animosity between each other
22:59because of what she's heard.
23:00So, she never really liked me, but once she wrote that I can't wait for her to get here,
23:05I was kind of, you know, excited, like, okay, Markeia might come up to see her when I had her.
23:09Markeia was nowhere to be found.
23:10She never came up there, she never texted me congratulations,
23:13but she was on Facebook saying she couldn't wait for her niece to get here.
23:16Okay, I said that, and then after that, at the hospital,
23:18when my mom was there until three o'clock in the morning with you...
23:20You're right, your mom was there with me.
23:22Okay, let me speak.
23:22I am very appreciative of your mom being there with me.
23:24Let me speak.
23:24I'm not saying.
23:24Let me speak.
23:25Speak.
23:25She went to work the next day, sleepy as ever.
23:29She's doing all this, and she calls me crying,
23:32saying that she finds out that her sibling had an extra finger also.
23:35And this is something that I believe that she was told.
23:38I don't believe that...
23:39I was not...
23:39Listen, listen, lady.
23:40I'm sorry, Your Honor.
23:42Markeia, what you're saying is you believe she always knew
23:46there was a family member on her side that also had the sixth finger.
23:50Yes, I think that it's inevitable.
23:51But was hiding that information purposefully.
23:54Yes.
23:56Ms. Fleming, in that moment when you heard about her family member also having the sixth finger,
24:02that was the moment you began to doubt.
24:04My heart dropped to my teeth.
24:05She was so different.
24:05I had everything in me that it took to stay there the whole time,
24:10because I was like, what do I do?
24:11Do I stay or do I go?
24:12And now it's, I'm back at 50-50 again.
24:14So when the baby's born, I'm looking.
24:15I'm looking for anything.
24:16I'm grasping for straws.
24:17Does she have his fingers?
24:18Does she have his toes?
24:19Does she have anything?
24:20But I can't find anything.
24:22So the very next day, I went up to the hospital and I sat down and I told Adriana and I talked
24:27to her mother and said, we're going to have to do a DNA test.
24:30I'm a very black and white person.
24:32I can't deal with gray.
24:33I can't not know.
24:34And it's not fair to her.
24:35She's beautiful.
24:36She has to know.
24:37It's not right.
24:39You submitted a statement from your son.
24:43It reads, no one on my side of the family sees a resemblance in Alina.
24:48So there's a very high doubt that she's not mine.
24:52I don't really know, but I strongly believe and want her to be mine.
24:56I love her.
24:57I just don't see a future with her if Alina is not mine.
25:02Her meaning Miss Jemison.
25:03He doesn't see a future with Miss Jemison if Alina is not his.
25:06I think he'll have a hard time getting over the fact that she's not his.
25:11He wants nothing more.
25:12He wants nothing more in this world.
25:13He really and truly wants it.
25:15He really and truly wants it.
25:16And he told me that he feels like the baby is his.
25:18He doesn't feel like she's not his.
25:20He doesn't like the tension.
25:21He doesn't want the tension between the two.
25:23It's only them that don't see that that's his baby.
25:26I've taken her to his previous jobs.
25:29I've taken her out anywhere.
25:31And people that know what he looks like and then know what I look like,
25:34when I first brought her home, when people see her, they're like,
25:37wow, she looks like both of you.
25:38She looks like you, but you can see Calvin.
25:41I brought him to his job.
25:43She's like, she...
25:45Wow, she looks just like him, but she looks like you.
25:47Like, there's a resemblance that they look alike,
25:49but she favors me more.
25:50My mom has jeans like that.
25:52Jemison, you've brought a witness.
25:54I'd like to hear from him.
25:55Sir, would you stand, please?
25:56Yes. Yes, Your Honor.
25:57Stand at the podium.
25:58And your name?
25:59My name is Calvin Carthon Sr.
26:02You are. So, you are Mr. Carthon's father.
26:04Yes, I am.
26:05And you are standing next to Ms. Jemison.
26:07Yes, I am.
26:08And the reason being is because I'm in full support of Adriana.
26:12Uh, I would represent my son, um, and my son wishes,
26:16and I know he would be here with her right now as we speak.
26:20And that's why I'm here.
26:21So, you believe...
26:23Your Honor, he hasn't talked to my son.
26:25...that your son's belief.
26:27He hasn't talked to my son since my son has gotten arrested.
26:30No, that's not true. He spoke to him last week.
26:32I put him on a three-way.
26:33Oh, that was the first time in six months. I'm sorry.
26:37So, Mr. Carthon, you believe your son is the father.
26:41You believe Alina is your grandchild.
26:44Well, Your Honor, we have to first keep in mind
26:47that there is a young child at stake here.
26:50You know, the future of this young child, regardless of what,
26:53whether C.J. is the biological father or not.
26:56I am too, but I feel like we still have to have the truth
26:59and we have to know, regardless.
27:02I have no objection...
27:04So, Ms. Fleming, I want to take a moment
27:06and understand your lawsuit.
27:08You are suing for $500 in expenses
27:11for items you've purchased for Alina.
27:14Am I correct?
27:15Yes, ma'am.
27:16Did you bring proof of any of those expenses?
27:19No, Your Honor, after we discussed it,
27:21and I just had a hard time pulling things together
27:25and to even move forward in that direction
27:27with trying to tally what I've done for her.
27:30At the end of the day, it's not about the financial aspect of it.
27:33It's about the baby.
27:34So, yes, we did talk about that,
27:36but I have a very hard time attempting to pursue that
27:38because I care about her.
27:40I care about the baby, and whatever I gave her is hers.
27:42So, Ms. Fleming, are you saying you'd like to withdraw your claim?
27:48Yes, ma'am.
27:49I just want to know if this is my baby.
27:52So, that claim is dismissed.
27:54I think at this point, the best thing to do
27:56is go to the results.
27:58It's time.
28:07These results were prepared by DNA Diagnostics,
28:11and they read as follows.
28:13As I mentioned early, in order to determine
28:15if Alina is the child of Calvin Carthon Jr.,
28:20we performed a grandparentage test using your DNA.
28:25Ms. Fleming and Mr. Carthon Sr.,
28:29it will basically determine the relatedness
28:33of the grandparents to the child, okay?
28:36In the case of Fleming v. Jemison...
28:42In the case of Fleming v. Jemison,
28:47pertaining to three-month-old Alina Carthon,
28:51it has been determined by this court,
28:54Ms. Fleming and Mr. Carthon...
28:58...are not related to Alina Carthon.
29:06I was hoping I was wrong.
29:08I'm sorry, I was not able to give you all the answer you wanted.
29:12We're gonna be...
29:13I'm gonna be 100% behind her regardless.
29:16You dream.
29:18Ms. Jemison, I do have to ask,
29:22are you certain this other gentleman is her biological father?
29:26Yeah.
29:28He am.
29:30He's so horrible.
29:33We don't have to deal with him, Adrienne.
29:35Oh, my God.
29:36I'm just so embarrassed.
29:43It's okay.
29:45It's okay.
29:46We're gonna take care of her.
29:47Oh, my God.
29:49Here, baby, it's okay.
29:50Oh, Marky, I'm sorry, but it is the other guy's baby.
29:55I'm sorry, but I didn't know.
29:57I'm sorry.
29:59It's okay.
30:03Ms. Jackson, you and your mother opened your case
30:07because your childhood sweetheart
30:09has now become your adulthood nightmare.
30:13You say the defendant and his meddling mother
30:17are now denying your daughter, Micaiah.
30:20You say you need help because your daughter has cerebral palsy
30:24and you want the defendant to man up.
30:27Is that correct?
30:28Yes, Your Honor.
30:29Mr. Brennan, you testify that you have substantial evidence
30:33that fuels your doubt.
30:36You say you are not the father, but know who is.
30:39Is that correct?
30:41Yes, Your Honor.
30:42So, Ms. Jackson, you want the defendant to man up.
30:45Yes, ma'am.
30:45Explain.
30:48I just wish he would be there for his child
30:51and step up to the plate with his responsibilities pretty much
30:55and be there like he was in the beginning when he didn't have a doubt.
30:58What is he doing currently for Micaiah?
31:02Zero. Nothing.
31:04So, Ms. Jackson, I can see the tears in your eyes.
31:07How does that make you feel as a mother?
31:09I can see the pain.
31:10Can you express that to the court?
31:12It hurts. It hurts a lot, actually, knowing that
31:14somebody so beautiful that took after both of us,
31:18that was made from both of us when me and him were thick as thieves.
31:22And everything just got torn apart because somebody didn't want to be a father.
31:28Mr. Brennan, you don't believe you are Micaiah's biological father?
31:34I have doubts.
31:34You do?
31:35Yes.
31:36And is the testimony of Ms. Jackson true that in the beginning you were there?
31:40In the beginning, yes, I was always there.
31:44And I actually got kicked out of their house.
31:46That's why I wasn't there. And they don't let me see her.
31:48I've asked for a paternity test before.
31:52Oh, my God.
31:53I've even got messages of that, but it's okay.
31:55This is crazy.
31:56I've asked for a paternity test more than once.
31:58Haley's told me no.
32:00And they tell us we'll never see the baby again.
32:02I mean...
32:02You missed out on all these years, and I think it's funny.
32:05I really do.
32:06I try to see her every year.
32:08It's funny and pathetic because you can sit there
32:10and act like, oh, poor victim me.
32:12And then Chris, oh, poor victim me.
32:15But you guys could have done a paternity test a long time ago.
32:18Instead of...
32:19Way a long time ago.
32:20So you missed out.
32:22Yeah.
32:22You did.
32:23Why should we have to fight for a paternity test?
32:25We've asked.
32:26You don't have to fight for one.
32:27When, yeah.
32:28We don't have to fight for one.
32:29That's what happens every time we try to talk to them.
32:30Yeah, that's what happens.
32:31So, Ms. Jackson...
32:32And I'm not listening to that.
32:33When's the last time Mr. Brennan saw...
32:35Well, you're gonna ask you, aren't you? Sorry.
32:36When's the last time Mr. Brennan saw Micaiah?
32:39Three years ago this December.
32:42All right.
32:42So, let's go back a bit because I do want to understand how we got here.
32:47You all were in a relationship.
32:49You were boyfriend and girlfriend.
32:50Yes, Your Honor.
32:51Sweethearts.
32:52High school sweethearts.
32:53Yes.
32:54And at some point you find out you're pregnant.
32:56Yes.
32:57During that pregnancy, was Mr. Brennan there?
32:59He was there throughout the whole pregnancy.
33:00He was supportive.
33:01Oh, yes.
33:02Take me back to that time and explain to me what was going on then.
33:05Okay.
33:05So, I found out I was pregnant.
33:08We started talking about everything and he was there.
33:11We hung out all the time.
33:12We walked together almost every day whenever it came down to getting ready to have a child.
33:18When my water broke, I woke him up and he immediately jumped up and took me to the hospital.
33:23During your pregnancy or at the birth, did he ever question paternity?
33:28He did.
33:29He did?
33:29He did.
33:30He did.
33:30What happened?
33:32Um, before I had got pregnant, I was with one of my exes when me and him were on a break.
33:42And then after that, we got back together and we were super close, inseparable.
33:48When I lived with him at his mother's house...
33:50She disappeared for three weeks, Your Honor.
33:52And then she comes back a week later and she's pregnant.
33:56Ms. Jackson disappeared for three weeks?
33:58She disappeared for three weeks.
34:00That's false information.
34:01That's false information.
34:02So, was that the beginning of your doubt, Mr. Brennan?
34:06Through our whole relationship, I was cheated on.
34:10I kept getting cheated on.
34:11So, I, you know, in the back of my head...
34:13And you cheated on me all the time.
34:15What happened?
34:15So, you always had this doubt?
34:17At your mom's house.
34:17I'm not the one that gets pregnant.
34:18And took pictures of it and put it on Facebook and showed everybody
34:21that you were cheating on me the whole time.
34:23I'm not the one that got pregnant.
34:25You get pregnant, not me.
34:26Oh, well, that's what happens when...
34:27But you can...
34:28So, listen, I can see that this relationship got very messy.
34:34And that's why we're here to try to sort through this.
34:36Because at the end of the day, we have beautiful little Micaiah.
34:40Beautiful.
34:40And she needs to know who her biological father is.
34:45Ms. Winters, I want you to finish your testimony.
34:48You know, he loved this girl since they were kids, you know, 14 years old.
34:54And of course, I mean, he's still...
34:56I mean, he had loved her.
34:58This is all hard on him, Your Honor.
35:00But yes, she disappeared for three weeks.
35:02She comes back a couple of weeks later pregnant.
35:05And it's like, I've always had the doubts,
35:07but I don't want to have the doubts because she's beautiful.
35:11So, take me to the day Micaiah was born.
35:14Were you at the hospital, Mr. Brennan?
35:16Of course.
35:17You were there?
35:18I picked her up and carried her to my van and sped to the hospital
35:21and ran past every red light I possibly could to get her there.
35:24Did you sign the birth certificate?
35:26No.
35:27Ms. Jackson, I do need to ask, if Mr. Brennan was that present
35:31and very much involved in Micaiah's birth and her care,
35:37why wasn't he allowed to sign or be on the birth certificate?
35:40She was supposed to have my last name.
35:41I had the whole packet and he had permission to sign anything
35:44because I was under the influence of the drugs at the time.
35:47No.
35:47All right.
35:48And so, I've never seen it.
35:49I still ain't seen the birth certificate.
35:51Mom, I want to understand,
35:52when's the first time you even found out Mr. Brennan had doubt?
35:57Last October.
35:59Tell me what happened.
36:00I texted his mom and said,
36:02you know, do you want to see Little Precious for Halloween?
36:05I was going to stop over and let her see her.
36:08Nope.
36:08It wasn't her grandkid and I got evidence right here.
36:11I'd like to see that evidence.
36:16So, this is
36:19a text message between you and Ms. Winters.
36:24Yes.
36:24All right.
36:26Ms. Jackson, you text,
36:28oh, yeah, she's not your blood.
36:31Okay, I will see you in court, sweets.
36:34So, you know who the daddy is?
36:37And Ms. Winters, you respond,
36:39Haley knows.
36:41That's why all these years,
36:43she did not want a DNA test.
36:45And that proves I've asked.
36:46And that's a lie.
36:47And then Ms. Winters sends a photo
36:51and it says, here's the real daddy, dumb.
36:56Look at him.
36:57Look at the baby.
36:59Wow.
37:00So stupid.
37:01And this is a picture of the other man.
37:05Yes.
37:06Yes, Your Honor.
37:06Which looks just like me.
37:07So, Ms. Winters, why did you send this text?
37:10Your Honor, um,
37:12this gentleman, he's been away for a while
37:15and he kept calling me every week.
37:17Um, he's friends with Johnny.
37:19I get a phone call after about a year talking to him
37:22and he goes, he goes, Mama, Chris,
37:24he goes, I need to tell you something.
37:26I said, what, honey?
37:27You know, just like a son.
37:28You know, just like a son.
37:30He goes, Haley told me I was the daddy.
37:31Oh.
37:34That's really where my doubts start coming from.
37:36That's false also.
37:37So, Mr. Brennan, had you ever asked,
37:40this is a guy you know,
37:41so had you ever asked this guy
37:43if he'd had sex with Ms. Jackson,
37:46your high school sweetheart?
37:47Oh, I already knew they was.
37:49Oh, wow.
37:50I knew they was.
37:51That's how we became friends is because
37:53he was truthful with me
37:54and told me what happened in their past
37:56and he told me everything
37:58and I don't know why,
37:59but me and him got real cool.
38:00We became friends and then...
38:01Wait a minute.
38:02What did he tell you specifically?
38:04Uh-huh, uh-huh, uh-huh.
38:07Uh-huh, uh-huh, uh-huh.
38:08Yeah, I don't know if you want to go there.
38:10Okay, well, smooth it out
38:15and give me the general details about the fact...
38:17He slept with her before, during,
38:19and after we was together.
38:21Uh, who knows when they actually slept together.
38:23It was before, during, and after.
38:24Um, I don't know if it was while, you know.
38:27And when you have the false information.
38:28At the same time, I don't know.
38:29Well, I don't see why he would lie to me, though.
38:31Why would he lie to me?
38:32Okay, then why would he lie to me
38:33and tell me stuff that you were doing behind my back
38:35is why he became friends with you?
38:37You know what I'm saying?
38:38Whatever.
38:41Mr. Brennan, when you look at Micaiah,
38:42you look at those pictures.
38:44She looks just like me.
38:45She does.
38:46But if you open that other picture up,
38:48she looks just like him, too.
38:49You let somebody else get in your head
38:49and be the reason why you're not seeing your child.
38:51Yeah.
38:53I've tried to see her.
38:55I mean, I shouldn't have to fight.
38:56I can see the tears in your eyes.
38:57I can see this really mean something to you.
38:59I shouldn't have to fight to see my baby.
39:00Yeah, it does.
39:01I love that girl more than anything else in my life,
39:02and she's the only reason why I moved
39:04and keep pushing forward,
39:05because I don't have nothing else in this world.
39:07There's nothing else for me here.
39:08You had me.
39:08No, I didn't.
39:09You had all the other guys in the whole town.
39:12No, please.
39:12So, I heard as you were expressing yourself,
39:18you said when you look at her, she looks like you.
39:21She looks exactly like me.
39:22And then you feel like she also looks like the other guy.
39:25He looks just like me.
39:26Me and him look like twins, though.
39:27Why are you in tears, Ms. Jackson?
39:29What are you feeling?
39:32I just know who my baby's dad is,
39:34and it just sucks that we couldn't have had it.
39:36And I have to be here.
39:39It upsets me.
39:39Yeah, me too.
39:40It frustrates me that all this even has to even happen
39:44when it could have been done a long, long time ago
39:46between me and him and nobody else.
39:48If there's really that much of a doubt,
39:50I would have stepped forward,
39:52because I have no doubt.
39:54Ms. Jackson, I do need to ask you,
39:56because there is a paternity question,
39:59were you sleeping with other people
40:01during the relationship with Mr. Brennan?
40:03If we weren't together, I could do whatever I want.
40:06And you also disagree with the testimony
40:10where they suggested that you told this other guy
40:14that he was her biological father.
40:16Yes, I've never told him that.
40:19It's always been Johnny since day one.
40:21Always.
40:22Why would he say that?
40:23Why would he say that?
40:23Johnny knows this, and he knows how far up I was with him.
40:28I was super close to him.
40:29So why are you believing him over us?
40:31Yes, it was him, that's what I want to know.
40:33Because you're a loud mouth, and he tells the truth.
40:36You don't want to see your granddaughter
40:37because of what someone else said.
40:39Oh, I'm going to see her, believe that.
40:40I'm not talking to you, I'm talking to your mother.
40:42Believe that.
40:42You want to meddle in any other time.
40:44We'll see.
40:48You're lucky.
40:49Okay.
40:50Oh, I'm lucky.
40:51You're very, Your Honor.
40:52Oh, yeah.
40:53I've had a deal with this.
40:54I am lucky.
40:55Because I get to wake up every day and see her.
40:57It is a very intense situation.
40:58I am lucky.
40:58It is a very intense situation.
41:00There it is.
41:01I see that.
41:02The mamas here.
41:03There's a lot going on with the mothers.
41:06No, really.
41:07And as I see, I mean, I can barely get your daughter to testify
41:10because you talking over her and pointing.
41:13And I mean, it's a lot going on between the mothers.
41:16And it makes me wonder, are you two getting in the way
41:21of these two young people really having a conversation?
41:23I love you.
41:24I love you.
41:25No, I love you.
41:26No, no, no.
41:26I'm not saying...
41:28Well, listen, first of all, let's get something clear
41:31that everybody in the gallery knows.
41:34All of you care about one another because you all going at it so hard.
41:39When you don't care about people, you don't have all this to say.
41:42No, you don't.
41:42No, you don't.
41:43You just don't.
41:44You just done.
41:45Right.
41:46This, what I see is our childhood sweethearts
41:50and their respective mothers.
41:53You have love for her.
41:54I do.
41:55You have love for him.
41:56Yes, I do.
41:56You two still have love for one another.
41:59This is obvious for everybody in this room.
42:01Raise your hand if you don't believe what I just said.
42:03There's not a hand raised in this courtroom.
42:09Ms. Jackson, you are pretty much now, with the help of your mother,
42:13raising this beautiful baby girl by yourself.
42:15Yes.
42:16She's a beautiful little girl.
42:18Yes, she is. Thank you.
42:19And she deserves to know who her biological father is
42:24and she deserves the love and care of her father, her grandmother,
42:30and her entire village.
42:32Ms. Jackson, have you prepared yourself either way
42:35or you still maintain you know for certain Mr. Brennan
42:38is Micaiah's biological father?
42:40I'm certain.
42:42Mr. Brennan, have you prepared yourself either way?
42:45Mm-hmm. Yes, ma'am, I have.
42:47If she's mine, I'm coming for her.
42:49She's got a house. She's got her own room.
42:51She's got everything she needs in Tennessee.
42:53If she's not mine, I just don't want nothing to do with them no more.
42:56I mean, I'll keep up with the baby.
42:58And I will say hallelujah if you're not the dad.
42:59I don't want to hear nothing from them.
43:00I can't even... Believe me.
43:01I can't even... I don't even like hearing her voice.
43:04I don't even like hearing yours.
43:06It's scratching.
43:07So, Ms. Jackson, your daughter just said
43:09she knows for certain and has no doubt
43:11that Mr. Brennan's the biological father.
43:14And then you just say,
43:15well, I'll be happy if you're not.
43:17I know. I know he's the dad.
43:19I know he is.
43:20Because she... I mean, I'm going on what my daughter said.
43:22So, you're just running your mouth?
43:23I'm just running my mouth.
43:25You should be quiet when it's against your daughter's benefit.
43:27Amen.
43:28You know when to be quiet.
43:29Because your daughter says she knows for sure.
43:32And you come up talking about,
43:33well, I hope he ain't.
43:35Well, I really...
43:37Well, Donor, it doesn't matter what anybody else says.
43:38He's not gonna do anything.
43:39As long as I know.
43:40They're not gonna do anything anyway.
43:42It doesn't matter what the results are.
43:43So, you're just talking because you're angry?
43:46Very angry.
43:47All right.
43:47You don't really have a doubt?
43:49I don't have a doubt.
43:49All right.
43:50Well, let's see if, in fact,
43:53what you've testified to is true.
43:55I do have the results for you.
43:57Jerome?
43:57May I have the end of the room, too?
44:05These results were prepared by DNA Diagnostics,
44:09and they read as follows.
44:11In the case of Jackson v. Brennan,
44:19when it comes to five-year-old Micaiah Jackson,
44:25it has been determined by this court,
44:29Mr. Brennan, you...
44:35...are the father.
44:36Thank God.
44:38And I thought that, but when your son comes to you
44:40and tells you that she says you're not,
44:44I mean, you can only wonder.
44:45And then when you ask her and she blocks you...
44:47You had the doubt, but now that doubt is done.
44:51Yes, Your Honor.
44:53You wanted to be this beautiful baby's father,
44:55and you are.
44:55She might have a doubt.
44:56Yes, ma'am.
44:57Now, this is the legal lesson here.
44:59You are not on her birth certificate right now.
45:02Yes, ma'am.
45:03That's gonna be something you two have to get done immediately.
45:08Get that changed.
45:08And that's important.
45:10Not just for you, Mr. Brennan.
45:14That's important for Micaiah.
45:15You will then have a legal right to see your child,
45:19and you also have a legal responsibility
45:21to help care for her financially.
45:23No problem.
45:24I don't think you do have a problem with it.
45:26I think it was clear throughout this hearing
45:29that you love this baby and you want to be in her life.
45:32More than anything in the world.
45:33But there's too much noise here.
45:35Everybody running their mouth,
45:38but not enough people coming up with solutions.
45:42Right?
45:43Yeah.
45:44I agree.
45:53So, guys, if I don't think I should be curious to make this work all the time.
46:04I will continue to think,
46:05just a final review in the first session of someone's даже кол maga,
46:08so that two of us can't wait till dayа as much as possible.
46:10And that is, too.
46:13You think the players in the world and the rapture have even and the Sad party?
46:14That is a tipping moment to find a battle.
46:16And everybody taking .
46:17It's like all those powers like you.
46:18If the program are open,
46:20the Fly party is different and all those who fascinates.
