00:00I'm suing my ex-girlfriend for a total of $2,300 due to the fact that we both agreed to take an
00:06all-inclusive vacation for a week, which was non-refundable, and now I'm out of the money,
00:12and I am here today to stand before you to try to get that back.
00:15Why did y'all not go on the vacation?
00:17I'm from Monroe, Louisiana, a very, very small town, roughly 50,000 people.
00:23I've been, actually.
00:24Have you?
00:24Sometimes I feel like there's more cows than people.
00:26So it was very surprising when I found my ex-girlfriend in such a small town because
00:32she stood out like a sore thumb.
00:34How we met was actually at my cousin's wedding.
00:38I was introduced to Miss Ivy and Jenna Banks, and it was a very big surprise to me once
00:44I found out that they were related to me.
00:47How were they related?
00:48Ivy Banks is actually my biological cousin, and Jenna Banks is an adopted cousin who came
00:55from Singapore a couple months ago, and I had no idea that she was a part of this family.
01:01She's adopted, like I said, again, and it's very important for me to emphasize that because
01:07during this wedding, we were dancing, we hit it off, and lo and behold, I really enjoyed
01:14our time together.
01:15So you fell for her?
01:16You fell for her, Mr. Banks?
01:16Not right away, Your Honor.
01:17Okay.
01:18But eventually?
01:19We have a tumultuous relationship, to say the least.
01:22Okay, so let me get a couple things straight with you, Ms. Banks.
01:25So you are her, you all are sisters through adoption.
01:29Yes, ma'am.
01:29Tell me, around what age were you adopted?
01:32So I was actually adopted around the age of three.
01:34I don't know my biological parents, and from there, the stars kind of crossed, and I got
01:39so lucky and blessed to have two amazing parents and an amazing older sister.
01:43Although I'm not blood-related to them, they took me in like I'm one of their own.
01:47And raised you.
01:48Yes.
01:49Let's hear from you, Sister Ivy Banks.
01:51Please approach the court.
01:53Mr. Bailey, she's been sworn in?
01:54She has been sworn in, Your Honor.
01:55Excellent.
01:56Okay.
01:56Ivy Banks, tell me about, are you the older sister here?
02:00Yes, Your Honor.
02:00How was it when this sweet baby of three years old was brought to the family?
02:04I mean, it was like my mom brought her home from the hospital.
02:07There was no difference.
02:08I loved her since day one, and I protected her since day one.
02:11What do you know about this man and this relationship?
02:15I was told that they fell in love.
02:17He wanted to hide the affair because he was afraid of what our family would think.
02:23From the whole family.
02:23Yeah.
02:24And this was her first time falling in love.
02:27I had never seen it before.
02:28I knew what it was.
02:29I just didn't know who it was with.
02:30Got it.
02:31So it's a secret.
02:32Yeah.
02:32And tell me again, Ivy, how this is your family, this man?
02:36This is my biological cousin.
02:38So y'all are actually blood cousins.
02:41Yes.
02:41You are a cousin, not biologically because of the adoptive nature of the woman, Your Honor.
02:47Yes.
02:48Okay, ladies, hang tight.
02:49Let me go to you, Mr. Gabriel.
02:51You all are a couple.
02:52You do fall for her.
02:53You know, maybe begrudgingly.
02:55We don't have to debate that here today.
02:56But y'all are seeing each other, correct?
02:58It had a couple extra steps, Your Honor.
03:01Fill me in.
03:01We were very friendly at the wedding.
03:04Nothing happened.
03:05I thought she was very pretty.
03:06But again, she's my cousin.
03:10And so there was some dilemmas.
03:11It's something taboo about that.
03:13You know, blood or not blood.
03:15It's a little close for most people's comforts.
03:16I think society would say.
03:18Yeah, especially being from the South.
03:19Well, it's interesting because some might say the opposite.
03:23But nonetheless, continue, Mr. Gabriel.
03:25Yeah.
03:25So what started as a good friendship slowly blossomed into obviously something more.
03:31We would hang out all the time.
03:33Let's get to how this trip came about.
03:36We were at my house for a Christmas party.
03:39And we were all dancing, having a lot of fun.
03:42Jenna didn't have anything to drink, but I did.
03:44And I asked Jenna if she wanted to play video games with me.
03:48And it was just us two.
03:49And we ended up staying up an extra two hours.
03:52I could feel some tension rising.
03:54And I knew I had to interrupt this.
03:56So I said we should probably end the night.
03:59And in doing so, Jenna ended up actually walking under the mistletoe.
04:02She made a couple seductive comments towards me.
04:06Okay, that's not true at all.
04:07You're going to act like I was coming in here seducing you?
04:10Are you kidding me?
04:10No.
04:11Do you remember what you said?
04:12So this is an interesting situation, to say the least.
04:22Because I feel like since it's not a biological cousin, just an adoptive cousin, then there's
04:29no harm, no foul.
04:30There's no lizard raising.
04:32There's no genetic issues going on here.
04:36You're going to be raising a dang lizard, homie.
04:38However, I do think it's still a little strange, in my honest opinion.
04:43Because I feel like, yes, there's no biological relation here.
04:47But the relational cousinry type of situation is still there.
04:53So in my opinion, I feel like it would be a hard hoop to jump through, if you know what
05:00I'm saying, if it was me.
05:02Now, I'm not going to knock this guy's thing, you know, I'm not going to, you know, yuck
05:09this guy's yum, if you know what I'm saying.
05:11But I feel like he's going to try to put this on her and make it more like her fault, rather
05:17than take full responsibility to the fact that he actually wanted to have some hanky-panky
05:22with his cousin, his adopted cousin.
05:25But I want to know what you guys think.
05:27Do you think in this situation, just because she's adopted, that it's totally fine and there's
05:32no issue here?
05:33Or do you think that there is some sort of ethics to being cousins, whether you're adopted
05:38or not, that you just can't cross that line?
05:41I want to know your thoughts.
05:42So why are you saying yes, Ms. Banks?
05:43Because it was love.
05:44I was in love with him.
05:45We were absolutely together.
05:47I don't know what he's saying, that I seduced him and that we were not together.
05:49It was both parties all in.
05:52Okay.
05:52Ivy Banks, please provide some clarity here.
05:55He's denying that he was even with her.
05:57What is your recollection?
05:59Everything about her was different, the glow on her face, the extra smile, just-
06:03She had the look of love.
06:04Everything.
06:04We're all familiar with it.
06:05Yeah, yeah.
06:06So I knew something was up, 100% together.
06:08Why do you think he's denying it?
06:10Because he's embarrassed.
06:11Your Honor, we did not do anything yet.
06:12He's a Southern gentleman, you know?
06:13He has certain standards to uphold.
06:15Okay, so let me ask you this, Mr. Gabriel.
06:18Why were y'all going on an all-expense-paid romantic vacation together?
06:23Well, there was a couple, again, steps missed, so obviously-
06:25I know, and you keep missing steps.
06:27Will you get to the step that makes this make sense, Mr. Gabriel?
06:30Please, please.
06:33All right, order, guys.
06:35Your Honor, when she was under that mistletoe, she looked at me and said that she was looking for a kiss.
06:41Okay, so you gave her a kiss.
06:43Now get to the vacation, sir, please.
06:45You're asking the court to give you $2,300.
06:48That's not a little bit of money.
06:49So what in the world would make you have a reasonable expectation of this money from a woman that you were telling me you weren't even romantically with?
06:57Because we were hiding it, Your Honor.
06:59We were hiding it.
07:00I honestly don't know how her sister found out.
07:02So now you're telling the truth.
07:03So you were in a secret relationship with your cousin?
07:08Yes, Your Honor.
07:08Okay, so when did you two agree to the vacation?
07:12I'm trying to get to the money part if you really want to have this claim heard in front of the court.
07:16Who asked who on the trip, sir?
07:17I did.
07:19I wanted to actually see if this was something that we could broach the topic in front of our family and see if this was something that wouldn't be a complete failure.
07:27Okay, so you invite this woman who you care for on this romantic getaway.
07:31She says yes.
07:32Why did y'all not go on the trip?
07:33I got a phone call from my parents three days before the trip.
07:36They did find out about our relationship and let's just say they were completely disgusted.
07:41They told me to end it immediately.
07:42The whole thing was out in the open and you had to call the whole vacation off?
07:46Is that what it was?
07:46Yes, Your Honor.
07:47Okay, first of all, $2,300.
07:51I need to see evidence of this, sir.
07:53Do you have any receipts or anything with you?
07:55Your Honor, I'd like to provide some evidence for you.
07:56Please give that to my bailiff.
07:57Thank you, sir.
07:59Appreciate that.
08:00Okay, I see an invoice here to the villa that you all were supposed to be staying at.
08:07So you would pay for everything to the tune of $4,600.
08:10You want her half back at this point, yes?
08:13You better believe it.
08:13That's what you're suing the court.
08:14Okay, okay.
08:15Okay, and then let's see.
08:17We've got a text message here.
08:19Jenna, babes, let's go to Grenada.
08:21I know you're only working part-time.
08:23You can pay me later.
08:24Cool.
08:24She says, let's do it.
08:26Not sure how I can get away without telling my family.
08:29She acknowledges her sister Ivy's going to get suspicious.
08:31She says, I'll pay you half when I can.
08:34Also, I was told there was an image of you two lovebirds.
08:38Yes, Your Honor.
08:39I have that if you'd like to see that.
08:40Okay, yeah, let me see that.
08:41Please give that to the bailiff.
08:44Your Honor, I'd like to stress that you can clearly see that she wrote it verbatim that she would pay for half.
08:49Do I look slow to you?
08:50No, ma'am.
08:51Okay, so if you just saw me read the text message where I said, and read to this court openly,
08:58I'll pay you half when I can, thanks for planning.
09:01Do you think that I can't read, sir?
09:03No, Your Honor.
09:04Okay, so I can read just fine, sir, but thank you for your help.
09:06Okay, let's go to the plasma and see this photo of the lovebirds.
09:10Very cute.
09:11Nice looking.
09:12We were so happy, yeah.
09:13Yeah, you were happy.
09:15I can tell.
09:15You were happy too, Mr. Gabriel.
09:17I can tell it in your face.
09:18Let's get to you, Ivy Banks, the sister here.
09:21How did you find out that it was him?
09:23I knew you knew she was in love, but how did you find out it was your cousin?
09:27Yeah, how did you find out?
09:28Well, she told me.
09:29Sir.
09:29Can you let her talk?
09:31That's the last time for you, Mr. Gabriel.
09:33I don't need you reinforcing things I've read in my courtroom, and I don't need you mansplaining
09:37the questions that I'm asking from this bench.
09:40Continue, ma'am.
09:42Thank you, Your Honor.
09:42So when she started to explain to me that she was going out of the country, I figured
09:46out or figured that it was going to be with who she was seeing.
09:49Right.
09:49Kept pressing and kept pressing as, you know, sisters do, and she told me.
09:53Is that true, Ms. Jenna Banks?
09:56You eventually just told your sister.
09:57Yeah, she cried it out of me, yeah.
09:58Okay.
09:59And what was your reaction?
10:00It wasn't what I was expecting to hear, you know, it was a hard pill to swallow, of course,
10:04but because I saw the love on her face and, you know, just the change in her, I knew it
10:08was real.
10:09Okay.
10:09And did you tell the parents?
10:11I did.
10:11And do you think that you telling your parents is what telephoned over to his parents?
10:16110%.
10:17He's not lying to the court when he says that it is you betraying the confidence that
10:22you two agreed upon, Ms. Jenna Banks.
10:24You told your sister who told y'all's parents, who told his parents, who caused the whole
10:29thing to implode.
10:30At the end of the day, yeah.
10:31So this is the problem I have with the situation.
10:34If you're keeping a secret relationship with your adopted cousin, a secret, and then you
10:40are pursuing this relationship and getting really tied up in each other, if you know
10:44what I'm saying, perhaps maybe even some mattress polo in Granada.
10:48I feel like eventually this information is going to break loose and get out there anyways.
10:55So I'm a little confused as to what the purpose of keeping this a secret was.
10:59Were they not planning on being together for a long?
11:02Was this just a little short fling to kind of get off some, you know, weird situ, you
11:07know, weird things that you might be into or something?
11:10I don't know.
11:11I just don't understand why it's such a big deal that you were keeping it a secret and
11:16then it got out when in fact, if you really truly were into each other, then perhaps
11:21maybe you just share that information right off the bat.
11:24I want to know, do you guys agree with this or do you disagree?
11:27I feel like he is still going to get the money.
11:31I don't think it matters that she shared the secret to him getting the money because she
11:36did say that she's going to pay for half.
11:40But I want to know, do you guys think this dynamic is strange?
11:43Do you, would you keep it a secret?
11:46You know, what are your thoughts on this?
11:48Okay.
11:48I've heard enough from, from, from everybody involved.
11:51Uh, Ivy Banks witness here.
11:53That was very helpful.
11:54You can have a seat, ma'am.
11:56Uh, I'm ready to rule on this.
11:57Here's the deal.
11:58Uh, what grown folks do is what grown folks do.
12:00Personally, love is very hard to find in my experience.
12:03I think if you find love anywhere in this world, you should run and grab it.
12:06However, uh, you know, you all have made decisions around societal norms and expectations and parental
12:13pressure.
12:13And maybe once you live a little longer, you'll stop doing that.
12:16In the meantime, sir, I see where you have paid here, the $4,600.
12:21Ma'am, you did say and volunteer to pay him your half when you could.
12:25The court is determining today you can and you must pay this man for his expenses.
12:30This court finds in favor of the plaintiff for the requested amount of $2,300.
12:34That is my ruling.
12:36All rise.
12:37Judge Ebony has ruled in favor of the plaintiff.
12:40The defendant is ordered to pay $2,300.
12:44I just can't believe you did this to me right now.
12:46Are you joking?
12:48You just couldn't wait?
12:48Are you joking?
12:49You had to take this to court?
12:50I was in love with you.
12:51I'm in love with you.
12:52Why would you do this to me?
12:54Well, it looks like they're going to have some issues to kind of handle after this court
12:58case.
12:59I feel like it's a really strange thing to claim that you're still in love with your cousin
13:03and take them to court.
13:05Now, I do think that he wants the money and deserves to get the money back because she
13:09did say she was going to pay for it.
13:11But this is a really strange dynamic.
13:13For me, whether or not someone is adopted or not, if they are related to me or have some
13:20sort of title to their name as sister, brother, cousin, second cousin, step brother, step
13:27sister, you name it, that automatically in my mind removes them from any sort of attraction,
13:36if you will.
13:37I don't think I could ever make that work, regardless of biological relation or not.
13:43So I want to know, do you think that most people feel the same way I do in this situation?
13:49Or do you think it's completely fine for them?
13:52Judge Ebony said, it's very difficult to find love, so I think you should grab it when
13:57you can find it.
13:59I don't always agree with that statement because that doesn't necessarily mean that it's best
14:04for you.
14:05But, you know, they decided that they wanted to do it.
14:08And it seems like they're both very much in love with each other still.
14:12So what do you guys think about the situation?
14:14Because I feel like, yes, he deserves the money.
14:17That's gone.
14:18We don't need to talk about that anymore.
14:20But I do feel like this is an odd situation between the two of them and then their family.
14:26I mean, it will make things very strange and awkward if they get together and do end
14:31up getting married and starting a family because they are, by association, cousins.
14:38I guess, but not by biological relation.
14:41So there's no issue there technically, but then there is kind of this weird social norm
14:48situation that's going on.
14:49What do you guys think about this?
14:51Do you agree?
14:51Do you disagree?
14:53Should they be together?
14:54Should they not be together?
14:54How would you react to this situation?
