The ruling keeps in place a lower court’s block on the order. The order sought to deny citizenship to children born in the U.S. if their mothers were unlawfully present and their fathers were not citizens or permanent residents. The panel found the Justice Department had not shown a strong likelihood of success on appeal. Trump-appointed Judge Danielle Forrest concurred, stating that legal challenges to new policies do not automatically constitute an emergency.
