चंडीगढ़ में 24 जनवरी को नहीं होगा मेयर चुनाव, 29 जनवरी तक टली तारीख, हाईकोर्ट का फैसला

चंडीगढ़ में मेयर का चुनाव फिलहाल 29 जनवरी तक के लिए टाल दिया गया है. पंजाब एंड हरियाणा हाईकोर्ट ने ये फैसला दिया है.

00:13Thirdly, they said that when the notification was issued by the Deputy Commissioner,

00:22He is a nominated councillor who has applied in the Prescribed Authority.

00:26It is his jurisdiction.

00:28The first issue was rejected by the petitioners.

00:32It will not be approved on 20th February.

00:34At the most, it will be approved on 29th or 30th January.

00:37He will continue till 29th January.

00:39Because the previous meeting, which the Supreme Court did not satisfy,

00:44the court accepted that it is valid.

00:47It will not be approved on 29th January for a year.

00:50That is why the notification was rejected.

00:53A new notification will be issued after 29th January.

00:56The show of hands petition was also rejected.

01:02The resolution passed by the Municipal Corporation is valid.

01:05It will go to the Governor.

01:07The Governor may consider it or reject it, whatever.

01:10There is no time for that.

01:11The Administrator, who is the Administrator for Chandigarh.

01:14The third contention, the Chandigarh Administration said in its reply,

01:18that we took precautionary measures.

01:20Because there is a fight about which officer is allowed and which is not.

01:24That is why we have no objection.

01:26You may satisfy that portion of the notification.

01:29Because we had a fight last year,

01:32that who will assist the officer,

01:34or there is no point in assisting the officer.

01:37The prescribed authority has made a nominated councillor.

01:40How can we overcome that?

01:42So, all three contentions,

01:44according to my understanding,

01:47all three were rejected and the third one was approved.

01:50Their main concern was that we will get a year from February and they rejected it.

01:55The writ petition that was listed here,

01:58we filed it last week.

02:00Our main prayer was in it.

02:02Kuldeep Kumar, the Mayor of Chandigarh,

02:05had filed it.

02:07We had two prayers in it.

02:09The first was that the tenure,

02:11when the petitioner was elected from the Supreme Court on February 2,

02:16the election was satisfied and he was elected from the Supreme Court on February 2,

02:21the tenure of one year was reduced by January 24.

02:26This was the first ground.

02:28The second ground was that

02:31the regulation,

02:33a meeting was held on October 29,

02:36in which the resolution was passed by the House,

02:40and the regulation was amended

02:42that the elections should be by show of hands.

02:45We filed the writ petition in the High Court.

02:48The High Court ordered that

02:53on the day of the election on January 30,

02:57the election was satisfied on February 2,

03:03and the election was held on January 30.

03:05Therefore, the date of the Mayor's election is January 30,

03:12and the tenure was held till January 29.

03:15The notification on January 7,

03:18in which the election was held on January 24,

03:20that notification was satisfied.

03:23The administration was given the direction

03:26that the election can be held after January 29,

03:30and a fresh notification can be made after that.

03:33Apart from this, there was the issue of show of hands.

03:35In the show of hands, the court ordered

03:38that the administration reconsider it,

03:41because the regulation was already passed.

03:43After that, the government had a ground

03:46that the government has to approve it.

03:48The court said that it is approved

03:50that it should be reconsidered

03:52whether it should be done in this election or not.

03:55Apart from this, the third ground was that

03:57the prescribed deputy commissioners

04:00had already appointed an officer

04:03from the presiding officer

04:05to count the votes.

04:07They were already appointed by the DC

04:10The court also satisfied the illegal order.

04:14Apart from this, there was the issue of videography.

04:17The court ordered the videography

04:20to be preserved in the same way

04:22as the first direction was given.
