00:00Mr. Speaker, pursuant to Clause 2A1 of Rule 9, I seek recognition to give notice of my
00:06intent to raise a question of the privileges of the House.
00:09The form of the resolution is as follows, H. Res. 1344, finding that Merrick Garland,
00:16Attorney General of the United States, is in contempt of the House of Representatives
00:20for disobeying a certain subpoena.
00:22Finding that Merrick Garland, Attorney General of the United States, is in contempt of the
00:26House of Representatives for disobeying a certain subpoena.
00:29Whereas, on February 27, 2024, Merrick Garland, Attorney General of the United States, was
00:35duly served with a subpoena to produce a narrow and specific set of materials possessed by
00:40the Department of Justice and related to Special Counsel Robert K. Herr's investigation of
00:45President Joe Biden's willful mishandling of classified documents.
00:53The House will be in order.
00:56Willful mishandling of classified documents to the Committee on Judiciary of the House
01:00of Representatives and the Committee on Oversight and Accountability of the House of Representatives
01:04in Washington, D.C.
01:06Whereas, Attorney General Garland has, in disobedience of such subpoenas, failed to
01:11produce the set of materials and whereas a set of materials possessed by the Department
01:15of Justice in material is unnecessary in order that the House of Representatives may properly
01:21execute the functions imposed on it and may obtain information necessary as a basis for
01:26such legislative and other action as the House of Representatives may deem necessary and
01:30proper.
01:31Now, therefore, be it resolved that Merrick Garland, Attorney General of the United States,
01:36is found in contempt of the House of Representatives for disobeying the February 27, 2024, subpoena
01:43and the Speaker of the House of Representatives shall impose a fine which may not be paid
01:48with appropriated funds on Attorney General Garland of $10,000 per day until such a time
01:53as Attorney General Garland complies with subpoena of the House of Representatives by
01:57turning over the audio tapes.
