Former prime minister Datuk Seri Najib Razak will be submitting a new application for a full royal pardon.

His lead counsel Tan Sri Muhammad Shafee Abdullah confirmed this during a press conference at the Kuala Lumpur Court Complex on Wednesday (Feb 7).

Muhammad Shafee said Najib's defence team was waiting for the right timing to submit their fresh application.

On Feb 2, the Federal Territories Pardons Board halved Najib's 12-year jail term to six years and reduced his fine from RM210mil to RM50mil.

00:56 In the court, he never received a fair trial.
00:59 In the pardon also, he is not getting a fair cut of the procedure.

01:07 So why is it on Dato' Sri Najib?
01:11 You know, it didn't sound right.
01:15 Dato' Sri Najib should not be in the prison, not even for a day,
01:20 because his constitutional right has been taken away.
01:23 Do you apply for a new pardon?
01:26 I'm waiting for... No, no deadline.
01:28 Those who say, you know there's a lot of people who are lawyer buroh,
01:33 who keep on saying you must serve three years, then only you can apply.
01:38 They have forgotten there are exceptions.
01:41 I've just given you how many exceptions of what went wrong in the first pardon.
01:46 I must reiterate, my client is not totally happy about the fact that he didn't get a free pardon
01:52 because of what he has been denied.
01:54 But to answer your question squarely, we are waiting for the right cue from my client

02:12 would you be able to tell us in brief why you're submitting another request for pardon?
02:17 The reason why we wanted to make another request is because we don't think the pardons board,
02:25 without denoting any blame to any particular person or persons,
02:30 I don't think the pardons board operated the way the constitution expects them to operate.
02:36 The young reputed honourable merely hears opinion and advice,
02:41 which he must, he must hear the advice and opinion,
02:45 but he decides on his own.

02:50 Dato' Sri, I just want to ask you this question.
02:53 You said you're waiting on a word or instruction from your client in regards to submitting a new request for a pardon.

03:01 What is your criteria or date in which you would pick to send this request for pardon?
03:08 Is there a specific date? What kind of time frame?
03:11 What kind of stars have to align in order for that to happen?
03:16 I don't wait for any stars.
03:20 Although to the Chinese they'll be quite happy.
03:23 Although I'm born in the year of the dragon, we don't work on the stars or the year.
03:28 But certainly I don't want to push it too fast because the young reputed honourable has not warmed up his seat yet.
03:38 So that's one criteria, for sure.
03:41 And the other criteria is I want to wait for my client's instruction as to consideration of other factors.
03:48 Dato' Sri, as for the first Royal Pardon application, since Dato' Sri asked for a full pardon,
03:54 but in the end only got a permutation, so can he tell you what he felt besides disappointment?
03:59 He's disappointed. He's very disappointed because he has always argued
04:04 consonant with the minority decision in the Federal Court that he should not spend a day in the prison.
04:11 Dato' Sri, you mentioned the first Royal Pardon application,
04:17 because Dato' Sri didn't get a permutation.
04:22 And then he picked up from what I said, there's also a lack of a fair assessment in the pardon.
