00:00 The government has the power to release Najib Razak from prison under a provision of the
00:08 Prison Act 1955, despite the pardon spot granting the former Prime Minister only a remission
00:14 of his sentence.
00:16 Retired Court of Appeal Judge Hamid Sultan Abu Bakar said, "Section 43 of the Prison
00:21 Act allows for the release of any prisoner on licence but subject to regulations made
00:27 by the Minister."
00:28 The prisons come under the purview of the Home Minister.
00:32 Hamid said Najib could have been released on justiciable grounds after the dissenting
00:36 judgment of a federal court judge in the review application last year.
00:41 However, he said, there appears to be no existing regulations under which Najib may be released
00:47 and that regulations may need to be put in place by the Minister for the purpose.
00:53 Hamid said the process is independent of any applications to the Pardons Board and that
00:57 the ball is in the government's court.
01:01 Najib began his initial 12-year prison term on August 23, 2022, following the federal
01:06 court's dismissal of his final appeal in the SRC International case.
01:10 On Friday, the Pardons Board announced that Najib's prison sentence had been reduced
01:15 from 12 years to six and that his fine was reduced from 210 million ringgit to 50 million
01:21 ringgit.
