A lorry driver pleaded not guilty in the Batu Pahat Magistrate's Court on Monday (Oct 30) to a charge of reckless driving that caused the death of a fifth former last week.

00:15 Nur Azwan Ismail was accused of committing the offence at kilometre 13.5 of Jalan Kluang
00:20 Batu Pahat at 7.4am on October 25.
00:24 A video of the incident which was captured on a dashcam had gone viral.
00:28 Nur Azwan was charged under Section 41, subsection 1 of the Road Transport Act 1987, which provides
00:35 for a prison sentence of not more than 10 years and a fine of up to 15,000 ringgit upon
00:41 conviction.
00:43 Deputy Public Prosecutor Farah Wahida Muhammad Sharif proposed that the court impose a 15,000
00:48 ringgit bail with additional conditions besides suspending his licence.
00:52 However, lawyer S. Tamera, who represented the accused, appealed for lower bail as the
00:57 client has to support two wives and two children as well as his ailing parents.
01:03 She also requested that his licence not be suspended as driving a lorry was a client's
01:07 main source of income.
01:09 The court set bail at 8,000 ringgit with one surety and ordered the accused to hand over
01:14 his passport to the court and to report to the nearest police station once a month until
01:19 the case is resolved.
01:21 Pre-mention of the case and submission of documents was fixed on November 30.
