NEW YORK — A New York taxi driver has been charged with assault for the death of a man who tried to rape his wife.

Mamadou Diallo, a 61-year-old cabby, beat would-be rapist Earl Nash to death with a tire iron on Monday night in the hallway outside his Bronx apartment, the New York Daily News reported.

Nash, a 43-year-old career criminal, forced his way into Diallo’s apartment at around 9:15 p.m. on Monday and attacked his wife Nenegale. Nenegale told DNAinfo that Nash said he didn’t want money and was going to rape her.

Luckily, Nenegale’s sister was home. She tried to stop the attack, giving Nenegale the chance to call her husband for help.

Nenegale told DNAinfo she feared for her life in the roughly 20 minutes it took for her husband to get to their sixth floor apartment.

Surveillance footage from the hallway obtained by News 12 The Bronx shows Diallo arriving at the scene, but it is unclear if Nash — who was only released from jail on May 20 — remained a threat.

Nash appeared to be waiting for the elevator in an attempt to flee before Diallo’s arrival and the beatdown that would ultimately end his life.

Diallo got out of the elevator and almost walked right past Nash, but his wife shouted, “That’s him!”, according to DNAinfo.

Diallo claims he acted in self-defense when he hit Nash with the tire iron and was fighting for his family, the New York Daily News reported.

Nash suffered a fractured skull, and his blood was splattered all over the elevator and hallway, sources told the New York Daily News.

Diallo was initially charged with manslaughter, which was later reduced to assault. He later said he didn’t want to be a hero or a killer, and said he regretted Nash’s death, according to the New York Daily News.
