The prosecution seems overzealous in a state unfairly mocked for lax attitudes toward incest. Nicholas has been married to Jarrett's mother for five years and remains so. According to one interpretation of West Virginia law, that makes Nicholas a father to Jarrett, even though they are separated by only seven years.
Authorities allege Jarrett calls Nicholas 'father'. They allege they discovered the pair having sex after going to Nicholas' home to arrest him on a different matter. They claimed they studied the state's incest statutes before deciding to arrest Kelcey Nicholas and Lataura Jarrett.
