Did a Chicago cop have the right to shoot Marlon Horton? CCTV footage is unclear

The family of Marlon Horton, a young unarmed man fatally shot by an off-duty police officer in 2013, has filed a lawsuit against the city of Chicago alleging the officer used excessive force and seeking a settlement for what they say was a false arrest and wrongful death.

Surveillance footage released on LiveLeak shows much but not all of the confrontation that led to Horton’s death.

According to local news reports, Marlon Horton was sleeping in the lobby of a building on West Monroe Street when he was asked to leave by a female security guard.

Horton exited the building but then reportedly began urinating on a nearby vehicle, prompting the female security guard to again confront Horton.

Then a male security guard exited the building to confront Horton. The man was an off-duty police officer moonlighting as a security guard at the building.

Horton then reportedly scuffled with the off-duty cop and the female security guards, after which both security guards drew handguns.

The off-duty officer repeatedly identified himself as a cop and told Horton he was under arrest. But Horton refused to yield.

Horton was shot once in the chest and died soon after. The off duty cop says he shot Horton because he believed he and the female guard were in danger.

In the surveillance video, Horton does appear to lunge toward the officer before he is shot, but it will be up to a court to decide if the actions taken by Horton constituted a valid reason to use deadly force.
