Yes means yes: California’s controversial new college campus sexual assault law explained

California’s governor announced this week, that he has signed a bill into law that will make California the first state to define that only a clear cut “yes” grants consent during sexual encounters.

The legislation sponsored by California senator Kevin de Leon, is hoping to create a change in the culture of how college campuses in California prevent and investigate sexual assaults.

Rather than the more traditional "no means no," the definition of consent under the new bill signed by Governor Jerry Brown requires "an affirmative, conscious and voluntary agreement to engage in sexual activity."

Lawmakers say consent can be nonverbal, for example, a head nod or moving in closer to the person.

Advocates for victims of sexual assault support the new law because it challenges the notion that victims must have resisted during a sexual assault to have valid complaints.

The new law also requires California colleges that receive state funding to have policies covering more than a dozen situations that can arise in sexual assault or domestic violence cases, from protecting privacy to training campus officials and providing counseling for victims.
