Saif al-Islam, son of former Libyan leader Muammar Gaddafi, is in touch with the ICC and is claiming to be innocent.
The court, based in The Hague, has said it made informal contact with Gaddafi's fugitive son and is seeking to arrest him and bring him to trial on charges stemming from Libya's civil war.
(SOUNDBITE) (English) INTERNATIONAL CRIMINAL COURT PROSECUTOR LUIS MORENO-OCAMPO
"Yes, he says he's innocent and he will prove to the judge he's innocent. And then he is more concerned about what will happen after, if he is considered innocent by the court. So we explain to him the legal system, the judge will decide, what the consequence after, but we believe we have strong evidence."
However, surrender is not the only option for the 39-year-old, who has friends among desert tribes in Niger, Mali and other poor former French colonies in West Africa, the allies traditionally providing close security for the Gaddafis.
As well as enjoying protection from Tuareg allies, Saif al-Islam may be in the company of mercenaries from elsewhere in Africa, including possibly South Africa.

"For us it is also important to avoid … we have some information there is a mercenary group trying to help him to move to a different country. So we are also trying to prevent this activity."
