00:13Tongol.
00:13Magandang umaga po, Attorney.
00:15Magandang umaga, Maris, and to all your televiewers.
00:27They asked for more days to decide.
00:30Sa Monday na po nila pagdadesisyonan.
00:32Maraming konsiderasyon dyan.
01:30Nakakasama doon yung Section 270, is it about confidentiality or is it about the penal penalty doon sa officer na
01:40magdi-disclose doon?
01:41And then is Section 71 the only exception na yung paghingi ng permiso sa Presidente?
01:48Oo, exactly.
02:13Kasi in a way, they are separate entities doon sa nasasakda na si VP Sara at sya ka sa asawa
02:20niya.
02:21So how does it apply the doctrines by the Supreme Court and the Corporation Code doon naman sa mga corporations
02:29na yun?
02:29Pero attorney, I'm curious. Is there really a need for the signature of the President para mailabas yung records na
02:34yun?
02:34Nakasaad po ito sa batas, no?
02:36Pero alam naman natin, yung itong impeachment trial na ito, sinasabi, it's also political.
02:43So ano po ba? Kailangan po ba ng pirma ng Pangulo?
02:46Yan ang hindi pa natin alam, no?
02:48Kasi ang dalawang school of thought dyan, yung school of thought ng prosecution na sinasabi na yung impeachment proceedings overrides
02:57the confidentiality clauses of all the laws.
House of Representatives na each and every step of the impeachment proceedings or process, kailangan
03:26i-accord yung due process doon sa impeachable officer.
03:29So yun yung pagtutunggalian ng dalawang school of thought.
03:32Pero makakahugot din naman tayo sa previous experience ng previous impeachment courts, which is persuasive to this impeachment court.
03:41Kasi nung mga panahon sa corona impeachment, a subpina was issued to the BIR Commissioner Quimenares.
03:48And then, she was the one who asked the president, so para makasunod siya sa sabpina at hindi siya makontempt
04:00At doon sinabi ng presidente, okay, sige, since that is ayan na yung ginagawa ng Senado and I respect the
04:08workings of the Senate as a co-equal branch of government,
04:27At di nga rin malabag yung Section 270 kasi one of the things na i-considera mo sa pagsasampa ng
04:33mga criminal cases is if there is a justifying circumstance.
04:37And under the revised penal code, one of the justifying circumstance kasi is if you are just following a lawful
04:43order.
04:44So kapag may sabpina na, that is already a lawful order.
04:47So all this we will know on Monday, yung desisyon ng impeachment court.
04:51And kung kakailanganin pa yung pirma ng presidente on the same day, we will be expecting that?
05:03And now the persons na i-issuehan ng sabpina have their recourse in lorean.
05:09May remedies din naman sila dyan.
05:10And one of the remedies of the BIR Commissioner is to ask the permission of the President to do that.
05:17Alright. I'm just curious, bakit simple majority lang ang kailangan for the decision to sabpina the bank and tax records?
05:28Because under Article 11 ng Constitution natin, isina-add niya talaga na two-thirds yung final vote on an impeachment.
05:36So if the Constitution or any other law provides the specific number or fraction, yun yung susundin.
05:45If the law is silent on that, ang susundin is a simple majority.
05:57nagde-decide is a simple majority.
05:59Alright.
Does it have a bearing?
06:19If you look at how the impeachment court acted when Senator Judge Cayetano rose up, he was allowed to do
06:26that.
06:28First, the presiding officer wants to hear ano ba yung concern.
06:32Second, gustong marinig ng presiding officer and the whole court,
06:37ano yung connection ng concern na yun ni Senator Judge Cayetano doon sa matter at hand before the impeachment court.
06:44So, kaya siya pinayagan. However, it's already on the record kasi nga nagsabi na siya na ilagay na doon.
06:51So, hinayaan na lang. Although there is a parang point of view as well among the Senator Judges,
06:58that that is not the place to raise those kinds of issues kasi sa plenary.
07:04But of course, there is also the point of view of the Senator Judges na since wala namang regular session,
07:10then talagang napilitan lang na doon i-raise.
07:13So, I think yun yung sila na magdadetermine if that is proper or improper.
07:20Because of course, sila-sila lang rin naman na may kapanyarihan to have a fellow Senator Judge called out about
07:33So, parang kaya naman niya ginawa yun was because parang feeling niya,
07:46sa susunod na linggo, sa Tuesday to be exact?
07:49Based on the purpose na inilagay ng prosecution, na house prosecution panel doon sa kanilang pre-trial brief,
07:56ang nakalagay doon kasi is to testify and also identify the documents that was already, ano,
08:02and then to testify on the investigation that happened.
08:12and also confirm the process of how they did the investigation
08:16and how they weighed the statements of both parties,
08:22the respondent and of course, yung mga pinatunguhan na mga tao ng respondent
08:29when she made those statements.
08:40for this Article of Impeachment No. 4, pero hindi na sila isasalang,
08:44si Attorney Melvin Matibag na lang yung pinakahuli.
08:47So are we proceeding to the next Article of Impeachment already by next week?
08:50It seems so because the House Prosecution Panel last Wednesday
08:56filed a request for subpina and that was issued by the Impeachment Court
09:03to the Land Bank of Officials to bring documents at saka
09:07na mag-testify on the bank accounts, bank records ng DepEd sa Land Bank.
09:16Ito yung tumutukoy doon sa Article 1
09:20at doon nakalista yung mga testigo na yun.
09:23So we are expecting that the House Prosecution Panel will wrap up the Article 4
09:29and then proceed to presenting evidence for Article 1.
09:34Alright.
