00:18Una po sa lahat, kung ano po ba yung mga nangyari kahapon sa pre-trial conference na pwede po ninyong

00:25at kung ano po yung mga pinakamahalagang usapin na maaaring mag-set ng direksyon na itong impeachment trial nga po
00:34na ito?
00:35Well, una, nag-agree naman both sides. Dahil nagkaroon ng kunting disagreements doon sa proposed stipulations,
00:43nag-agree naman sila as directive by the court na mag-submit na lang sila ng comments.
00:49And then at the same time, tapos na rin yung, kung di po ako nagkakamali, is article 3 or 4,
00:56yung marking of evidence.
00:58So we are just waiting for the continuation sa Monday po, yung marking of evidence.
01:04Doon na rin po mapang-uusapan kung ano yung magiging proposed trial schedule from both sides.
01:10Kung ilang yung araw na nire-request ng both sides, both panels, kung ilang araw ang i-allocate ng Senado
01:16para doon sa actual na trial.
01:19So we're just waiting for the continuation of the marking of evidence as well as the submission of the stipulation,
01:28proposed stipulation and probably the agreed stipulation before June 22.
01:34Because June 22 would be the deadline.
01:37Speaking of the schedule, napag-usapan na po ba kung kailan ang magiging final date ng simula ng impeachment trial?
01:44Sa initial po na date indicated in the notice is July 6 ang umpisa po ng trial.
01:52This is based on the notice that we received from the Honorable Court.
01:56Doon po sa nangyari kahapon na pre-trial conference since it's closed door,
02:00Meron po ba mga procedural or legal na mga nakita kayo na maaaring maging punto ng pagtatalo ng prosecution at
02:09depensa?
02:10Well, una po yung mga stipulation of fact, even some portion of that,
02:15yung proposed na stipulation of fact na sinasubmate ng prosecution,
02:22some of them were actually challenged by the defense.
02:28In fact, that's the reason why medyo nagkaroon ng disagreement.
02:32But this is usual occurrence naman sa mga pre-trial conference.
02:37Yun nga, yung mga, I think the evidence that will be proposed also are being questioned by the defense.
02:44But again, these are the usual occurrence in a pre-trial conference.
02:48That's why para mas mapabuti, kasi ang intention talaga ng pre-trial conference is to simplify
02:52the discussions that will be out in the trial, medyo nadidelay because of some motions and some disagreements,
03:05especially coming from the defense panel.
03:08So, yes, I would expect that the defense would be raising technical issues in relation to the evidence
03:18that would be presented by the prosecution.
03:21Sinasabi po kasi ng kampo ni Vice President Sara na mahina o kulang yung mga ebidensya laban sa kanya.
03:27Pero gaano po kayo kakumpiyansa na matapos po nung palitan ng pre-trial briefs kahapon,
03:33e talagang sapat ang ebidensya ang iaharap ninyo sa darating na impeachment trial?
03:39Kung mahina yung aming ebidensya, e bakit sila mismo ina-adapt nila yung ating mga witnesses?
03:48In fact, sila mismo wala silang sagot, exacto na sagot doon sa mga ipinipresenta natin ng ebidensya.
03:55In fact, the reason why we expect, the whole country is expecting,
03:59na magpaposabit sila ng kanilang specific, substantial counter-arguments and contravening evidence,
04:06is also to answer, provide answers at saka pabulaanan yung mga ebidensya yung patresenta ng House Prosecution Team.
04:16So sila mismo, makikita natin yung pre-trial brief nila,
04:19ay basically going back to their old narrative na questioning the entire process,
04:27wala ako sila na i-offer eh.
04:29So if they think that what we will produce to the court is mahina,
04:36the more reason for them to counter this with specific and substantial contravening evidence.
04:41Pero sa nakita natin, wala eh. Puro sila technical questions sila.
04:44That's why medyo nagkaroon ng palitan during yesterday's pre-trial conference.
04:49Pero na-tensyon.
04:51Well, I would not say that-tensyon because that is actually expected.
04:55Every pre-trial conference, all lawyers would attest na nagkaka-
04:59Kasi adversarial na from the beginning ang kanilang position dyan eh.
05:02So we would expect really some sort of disagreements, of course.
05:05Disagreements. Alright.
05:06Pero supposedly dapat kasi stipulation of facts yan eh,
05:09ang ikocontest mo lang ito aday to admit or to challenge the facts being presented.
05:15Pero I'm not sure kasi hindi na tayo, hindi man tayo kasama doon
05:19during the pre-trial conference.
05:20But what happened is we assumed that and we anticipate that there will be some
05:24technical motions that will raise in the coming days during the pre-trial conference
05:29up to June 25.
05:31But we anticipate naman and we are ready for that.
05:33Yes, yes. We understand.
05:34Sa lunes na po yung susunod na pre-trial conference,
05:38closed door pa rin po ba ito?
05:40Ano po?
05:42Yung pre-trial conference po na pagpapatuloy sa lunes,
05:45closed door pa rin po ito?
05:47Ah, that's so far yung po yung alam natin.
05:50It's a continuation of what we, what they have started yesterday.
05:54So, ah, well obviously that's going to be the ruling pa, no?
05:58Unless of course the impeachment court decides to, decides otherwise,
06:02to let others to, ano, cover the pre-trial conference.
06:06Kasi ang alam po, ang gusto din nila is mas smooth,
06:09is mas efficient yung pag-uusapan.
06:11Ah, para hindi masyadong ma-delay pa,
06:15at saka hindi masyadong magkaroon pa ng unnecessary na, ano,
06:19distractions.
06:20So I think that's the reason why they wanted it to be closed door.
06:24At the same time, yung safety din yung magiging possible
06:27na mga witnesses na ipoproduce ng both the defense and the prosecution.
06:31Si Sen. Chisa Scudero po ang posibleng ihalal na presiding officer
06:35na impeachment trial.
06:35Ano po masasabi rito ng House Prosecution Panel?
06:38Well, sa amin naman, ready naman po kami.
06:41Handa naman po kami kung hindi naman po ang ma-uupo dyan as presiding officer.
06:46Dahil ito po ay desisyon ng Senado
06:48at meron naman po silang institutional independence
06:54para po pag-decida nila kung ano yung magiging internal matters, no?
06:59When it comes to who will be the presiding officer.
07:01So sa amin naman po, what is important is gumugulong na bang ito,
07:05itong pre-trial conference, nag-start na po ito,
07:07at masaya po kami dahil yung accountability mechanism ng ating konstitusyon
07:11na palagi naman po namin sinasabi,
07:13ay nararamdaman natin at umuunsad na.
07:16Sa kasalukuyang pong komposisyon ng mga Senador,
07:18paano nyo nakikita ang magiging directional impeachment trial?
07:21Especially with everything that has happened in the Senate,
07:24nagpalitan, pumunta sa kabilang kampo,
07:27ano po ang nakikita nyo rito?
07:29Well, sabi naman po, ang aming ilalatag dito
07:31sa ebidensya sa taong bayan at sa ating mga Senador, no?
07:34Yun naman po talaga yung trabaho natin dito,
07:37at saka yun naman po yung duty na binigyan ng Constitution's House Prosecution Panel.
07:41We will rely on our evidence and we will present them as effective
07:46and as easy to understand by the public as possible.
07:50Yun po yung atin dito, pananagutan, accountability,
07:54at inaasaan po natin na itong mga ebidensya na ipapresenta ng House Prosecution Panel
07:59ay may counter-evidence din ang defense.
08:02So sa amin po, yun po yung pinaka-priority
08:06ng ating House Prosecution Team
08:08na may ilalatag po ang ebidensya
08:10at makita ng taong bayan na itong charges na ito
08:12ay basi-basi po sa mga solid na mga ebidensya.
