00:00Kenny wants to express his deepest sympathy for the part that he played in the death of Matthew Perry.
00:06Mr. Perry was a man, a friend, his boss, someone who he had the deepest affection for.
00:14He's been devastated since his death, and he continues to be devastated.
00:22I do want to emphasize that Kenny at all times acted at the direction of Mr. Perry.
00:32He obtained ketamine at the direction of Mr. Perry, administered ketamine to Mr. Perry at his direction.
00:44And as his employee, Kenny wishes he could have had the strength to push back and say no.
00:53And for that, he'll ever be, well, he'll always be remorseful.
01:02I do want to say that Kenny is not the only person here that partook in this tragic event.
01:16Mr. Perry had agency here.
01:18Kenny could have said no, and Mr. Perry could have said no.
01:25And Mr. Perry's loved ones could have been there to say no and help him.
01:31So, to the extent that all the fault and the blame falls on Mr. Iwamasa, who, in our opinion, is
01:39on the low end of the totem pole,
01:41the only defendant in this case who has no financial interest in doing what his boss says,
01:50we believe that's an unfair narrative.
01:52The second assessment is that the judge did not impose an enhancement that the government sought,
02:00which was unfounded.
02:05The judge said she appreciated the mitigating circumstances in the case,
02:13but we feel that the sentence didn't reflect those substantial mitigating circumstances.
02:24The power dynamic here was disproportionate.
02:29One person had the power and one person had no power.
