00:00Judgment which has been delivered in the SIR matter, that is applicable in case of Bihar.
00:09That is not all India features.
00:15In this judgment, which I have heard, safeguard which had been provided by the election commission,
00:24that was sufficient, it has been held.
00:27But one interesting thing has been said that, if the election commission has no authority to decide who is citizen
00:35and who is not citizen.
00:38And if the election commission has deleted any name on the ground of the citizenship,
00:44then they should refer the matter to the appropriate authority under the Citizenship Act.
00:52And that appropriate authority will decide whether these gentlemen, these persons who are affected, they are citizen or non-citizen.
01:00If the appropriate authority hold that they are citizen, then their names should be included.
01:07Which we are saying for long that the central government has no power or police has no power to decide
01:13who is citizen and who is non-citizen.
01:16And then thereafter push them back.
01:20That is not allowed by the Supreme Court today.
01:25Now, in Bengal case is completely different.
01:29Bengal case is logical discrepancy has been made, which has not even been decided in Bihar case.
01:39In Bengal case, only the logical discrepancy has been inserted by the election commission of India.
01:45Therefore, our case is completely different.
01:48Procedural parties also, there were so many procedural lapses were there.
01:53There the Supreme Court has given the, when the matter was heard, you have seen the Supreme Court has given
01:59the safeguard.
02:00In case of an adjudication, election commission has not decided in our matter.
02:07The Supreme Court has said that these, these matters would be decided by the members of the judiciary of the
02:14West Bengal and others.
02:17And thereafter, the appeal forum has been created by the Supreme Court to decide the appeal that appeals are still
02:26in pending.
02:27Therefore, our case is completely different case.
02:30But, in principle, the Supreme Court has held that the SIR is constitutional.
02:38But the procedural safeguard has been given by the Supreme Court, so many, so many directions have been given.
02:45Unless I see the full judgment, I can't tell you what are the other safeguards have been given.
02:59Because it has been made very clear in this case, in this case, in this case.
