00:01This is the plaintiff, Nevada Green, she says.
00:04She went to the defendant's bar in her new suede sandals,
00:08went to the ladies' room, sat down to take care of business,
00:11and when she got up, her feet were all wet.
00:14Yuck!
00:14There was some kind of leak in the wall.
00:16Her sandals were ruined.
00:18She developed a strange infection in her feet, which now itch,
00:22and when she went to complain, the bartender jumped over the bar
00:24and punched her in the face.
00:26Bottom line, she got a fungus at the bar,
00:29and is suing them for $3,540 for new sandals,
00:33medical bills, transportation, and pain and suffering.
00:43This is the defendant, Denise Durrett, owner of the bar.
00:47She says this is the craziest thing she's ever heard of.
00:50The plaintiff never complained about wet feet or any kind of infection,
00:54and her bartender never hit her.
00:56This woman's making all of this up.
00:58Attempting some kind of shakedown or something.
01:01Oh, her?
01:02What a joke.
01:04She's accused of having a fungus among us.
01:12All parties, please raise your right hands.
01:14Welcome back to the People's Court.
01:15Next case on the dock, and the plaintiff went to the defendant's bar
01:17wearing suede sandals, sat in the toilet,
01:20says there was a puddle of water on the floor.
01:21She stepped in the water, got a fungus,
01:23and the bartender punched her to boot.
01:25Now, the defendant says simply, the plaintiff is nuts.
01:27It's the case of you put the sue in suede.
01:30Thank you, Douglas.
01:31You're welcome.
01:31Okay, Nevada Green.
01:33Yes.
01:33You are suing Denise Durrett's bar.
01:35You've asked us not to mention the name of the bar.
01:37Yes.
01:38You are Denise Durrett.
01:39Okay.
01:40For $3,540 that you say you are owed for pain and suffering,
01:45medical bills, and transportation costs,
01:48because according to you, you received an infection from her bar.
01:53What happened?
01:54Well, what happened was, it was a day in April or May of 2010.
02:03Now, before this, I was always coming into the bar,
02:06buying me a beer, and I would leave.
02:09Like a $40 or something, I would leave.
02:11Very suddenly, do I ever really stay, so I would leave.
02:16But this particular day, I comes into the bar in the year 2010,
02:22and Kelly was working.
02:24Kelly is who?
02:26The barmaid.
02:27That's you?
02:27And Kelly is your sister?
02:29Mm-hmm.
02:29Okay.
02:30Now, Kelly and I are friends.
02:33We don't hang out or nothing, but I remember her from elementary school.
02:37So when I noticed that she started working at the bar, it was amazing.
02:41Like, you know, so I would come in, you know, once in a while,
02:43we would chat for a few minutes or so.
02:46So I sat there at the chair at the bar, and I was drinking.
02:51I think I had one.
02:52I ordered probably one drink.
02:55And I had to use the bathroom.
02:58And I was dressed like with summer wear, because the summer was beginning.
03:03I mean, the spring wear.
03:04So I had some brand-new shoes.
03:06Usually, I go to Payless or Rainbows to get my little shoes,
03:10because I'm not a very expensive buyer, shopper.
03:13But I did purchase a pair of shoes from Lady Boutiques downtown.
03:18And there was some sandals.
03:20There was leather straps.
03:22But the footing part was suede.
03:25So they was nice and soft and comfortable.
03:27I'm disabled because I walk with a handicap.
03:31That means with a cane to keep me mobilized.
03:33What's wrong with you?
03:34Well, at that time, I was injured by a car striking me in the year 2005.
03:41So what is the injury that causes you to walk with a cane?
03:44I had a bad knee.
03:45Okay, bad knee.
03:46All right.
03:47So that particular day, you go to the bathroom.
03:49I'm trying to follow you, but you're making it hard.
03:50You go to the bathroom.
03:51Okay.
03:52Okay.
03:52So then I used the toilet as a woman, like I do.
03:55So I wound up doing the number two.
03:57That means I had a bowel movement.
03:59So I sat down for a longer length of time.
04:04Okay.
04:05Okay.
04:05So while I'm sitting there on the toilet, may I show you while I'm sitting in a seat?
04:10No.
04:11Okay.
04:12No.
04:12I know exactly what a woman looks like when she's on a toilet doing number two.
04:16While I'm sitting there, and I see the water.
04:20There was down.
04:21I did not notice much water.
04:24Where the water was coming from.
04:25In my seat.
04:27I'm sitting on the toilet, and, you know, I'm doing number two, and my feet are getting
04:33wet by this water.
04:34I'm sorry.
04:35Are you talking about standing water on the ground?
04:37Yes, it was water.
04:38Was the water coming out at that moment, or you had only...
04:40Well, yes.
04:40Yes.
04:40So I really couldn't see.
04:42I didn't...
04:42It didn't look like it was...
04:43It wasn't coming from the toilet.
04:44It wasn't coming up from the toilet.
04:46Okay.
04:46Okay.
04:47In the toilet or nothing.
04:48So I was still sitting there pooping.
04:53And I'm wondering, well, I can see the drainage.
04:55They're draining, but it's not coming from there, and I didn't know really where it was
05:00coming from.
05:01So now I'm sitting on the toilet for at least 20 minutes.
05:03Okay, so there's a drain in the bathroom?
05:04Yes.
05:05I believe that there was.
05:06If there's a drain, how high could the water get?
05:08I don't get it.
05:08Well, I don't know.
05:09See, like my sandals wasn't...
05:11I wasn't in high heels.
05:12My feet didn't get soaking wet, but my shoes were starting to absorb this water.
05:17Okay.
05:18To some kind of way, because I did not know that it was...
05:21Do you have the shoes here?
05:22No, ma'am.
05:24My house has been burglarized 10 times since I lived on Frankstown, and I'm currently living
05:30there, and I don't...
05:31And someone stole these shoes?
05:32Perhaps.
05:32So the last time that I remember seeing them was when I put my bed up on top of the
05:36other
05:36bed.
05:37So that was just within the last past six, I mean, six months.
05:40What is your premise, that you ended up getting an infection?
05:43Well, what happened was my feet got wet.
05:45Then I goes on out into the bar area, and Kelly was working.
05:51I says, Kelly, girl, lookie, there's some water coming in your bathroom.
05:56I know, stupid dummy.
05:58I know that.
05:58I says, what?
05:59I says, well, if you know that, then why didn't you just shut the...
06:03I mean, having no sign.
06:05No, I mean, can't use the toilet, I mean, the bathroom or something.
06:09Oh, well, don't worry about it like that.
06:12So in the meantime, because she called me stupid or dummy, it was one of those words
06:18she had used, stupid or dummy, I was like, so me and her had a few words, so then I
06:24left.
06:25Now, she didn't tell me then not to come back.
06:27You come back how much later?
06:28Okay, I came back like three months later.
06:32Okay.
06:33Okay, because I started having problems with my feet.
06:35So I had to make a thought disappointment, and I think the first appointment I probably
06:39missed because I had went to jail because of something else.
06:42Okay.
06:43Okay.
06:43Okay.
06:44So, I mean, yes, I'm very...
06:45I'm always in and out of jail now.
06:47So I'm saying when I first made the appointment, I think during the course of that doctor's
06:53appointment, I went to jail.
06:54Then I guess out and I had to make another appointment.
06:57When's the first time that you actually see a doctor?
06:59It was in May.
07:01Okay.
07:01Can I see the medical records?
07:03What is wrong with you?
07:04What did they tell you was wrong?
07:06Back then, what was wrong?
07:07They were trying to figure out what was wrong first.
07:10Did you tell them about how you were standing in water in a bathroom and that you thought
07:15that that had something to do with it?
07:16Yes, I did.
07:17Yes, I did.
07:17Mainly because I had knee problems.
07:19I didn't want anything.
07:21I had to make sure it wasn't for my knees.
07:23Yes, ma'am.
07:24Okay.
07:24So let me see the medical records.
07:26And you're saying that whatever damages you sustained as a result of that was an infection
07:30that you got at their bar as opposed to anywhere else?
07:32Yes, ma'am.
07:33Because I never had no problems.
07:34I ain't had no problems with my feet.
07:36What's going on?
07:39Me?
07:40Yes.
07:41I'm sorry.
07:43Yeah, I do own a bar.
07:44It's a small bar.
07:45It's in an impoverished neighborhood.
07:47And we get a lot of...
07:48How long has your bar been open?
07:50I've been there nine years.
07:51Nine years?
07:52Okay.
07:53And it's in a rough neighborhood.
07:55And we get a lot of undesirable people, a lot of drug addicts and drug fiends.
08:01Well, I hope they're not watching because you're going to lose your customers now.
08:04Well, we do get some of them.
08:07And we try to monitor and keep a lot of them out.
08:10Okay.
08:11So...
08:12No, but I got a lot of good customers.
08:13I have a lot of good customers.
08:14Yeah, you got to throw that in, honey.
08:15Yeah, I definitely have a lot of good customers.
08:17Okay.
08:17So anyway, I had no idea about this until about three weeks ago when I got a letter in the
08:25mail saying I was being sued.
08:26Okay.
08:26So come on up.
08:27You are Kelly?
08:28Yes, ma'am.
08:29Kelly.
08:29Yes.
08:30Go ahead.
08:30That's fine.
08:31So what happened?
08:32Did you have any contact with her before the lawsuit?
08:35Did she ever come up to you at the bar?
08:36She came in one day.
08:38She asked me, can she go to the bathroom?
08:40I was like, sure, you can go to the bathroom.
08:43She normally does, she comes in, I let her come in before we go to the bathroom, and
08:48I tell her, if she's not buying anything, she has to leave, because if you're not buying
08:51anything, you can't just sit in here and wait for somebody to buy you a drink or for
08:55you to ask for one.
08:55Isn't it a bar?
08:56Yes, ma'am.
08:58What's wrong with the last several hundred years where women go into bars and sit around
09:01and wait for somebody to buy them a drink?
09:02No.
09:03It's just...
09:03What's up?
09:05It's not.
09:05Just because of the neighborhood we're in, we just don't want people coming in there panhandling.
09:10And, hey, you going to buy me a drink today?
09:12Hey, you going to buy me a drink today?
09:13Okay.
09:14Hey, can I get in?
09:14Aggressive.
09:15Because we got good customers that come in.
09:18They just want to come in and chill out.
09:19Okay.
09:19And when somebody comes in...
09:21So you tell her she's got to move it on down and what happened?
09:23Right.
09:23Because she's definitely known in the neighborhood for going around and doing that sort of thing.
09:28Okay.
09:28Going in and asking people to buy her drinks.
09:31I mean, she's barred from a lot of bars in the area.
09:34Okay.
09:35So good.
09:35So what happened?
09:36So I let her in.
09:37She asked me, can she go to the bathroom?
09:39I said, sure.
09:41Go ahead.
09:42She went in.
09:43She came back out soon after.
09:46She didn't look like she sat down and did anything.
09:49She came out too quick.
09:51And then there was people at the end of the bar.
09:53They were...
09:54She started trying to talk to them.
09:55I gave her a couple of minutes to, you know, speak to the people.
09:59And I was like, okay, Nevada, it's time for you to go now.
10:02If you're not bad at anything, you have to go.
10:04And she's like, well, she does all like this.
10:09I'm like, come on, Nevada.
10:11I'm working.
10:11Don't do this.
10:12If you're not buying anything, you have to go.
10:15And there's guys in there.
10:16You mean, do you need me to get her out?
10:18Like, no, she's a girl.
10:19And I don't want to call the cops on her.
10:21So I'll get her out.
10:21I mean, I've been knowing her since elementary.
10:24So I finally get her to the door and out the door.
10:27She hits the door with the cane because she's mad because I guess she's embarrassed or whatever
10:32because she has to go because she has no money to buy anything.
10:36And after that, that's all.
10:38That's the last time I've seen her.
10:39Now, you say that she hit you?
10:42Okay.
10:42Now, three months later, when I come back into the bar to talk to Kelly about the incident
10:48that happened with the leaky wall that she said was leaking.
10:53And Kelly said, oh, get on out of here with that.
10:55Ain't nothing happened to your feet here.
10:58And then.
10:58Okay, wait.
10:58So you told her.
10:59What did you tell her that she responded to that?
11:01I told her that.
11:03Do you remember that incident when you was telling me about her laughing about the leaking
11:06wall when you caught me stupid and dummy?
11:08I said, well, you know what?
11:09Now, I have an infection in my foot and it might be possibly from that water.
11:14Has anyone else?
11:15Oh, get out of here.
11:16You're not going through this hair right here in here and talking about no leaky water.
11:20Get on out.
11:21Get her out of here.
11:22And so there was a guy.
11:23So she comes around the bar real fast like and then she punched me just like that.
11:28And I was like, oh, what?
11:31And so then the guys come and they grab me up.
11:34They threw me out the bar.
11:36Then I picked up my cane.
11:37I hit the window, but it didn't break.
11:39That's what that's that's the day, but it didn't break.
11:42So that's that's that all this.
11:44And when I just wanted to talk to her, she punched me in front of all those folks.
11:47And I didn't do nothing.
11:48I was there to to meet somebody.
11:50Did I call the police?
11:51No, I thought that they was going to call.
11:53I waited a few.
11:54They didn't call the police.
11:55And then the guy that I thought that was going to come back.
11:57If he was in there, I didn't get all the way in there.
11:59I just got to the door.
12:01And do you have any other medical records besides the ones that you handed me?
12:04Well, I have some, but I haven't really got a chance to talk with the doctor to determine
12:09what one one medical record meant.
12:11OK, I have a couple of questions for you because this is what my concern is.
12:15OK.
12:16OK, she's got a million problems.
12:18You buying what she's selling?
12:19No, she sounds crazy.
12:21Is crazy enough to make her lose?
12:23Absolutely.
12:24She's out of her mind.
12:25And ma'am?
12:26Yes, I think so as well.
12:28Crazy is enough to make her lose.
12:29Yeah, but crazy people can also be victims, can't they?
12:33Yeah, I'd have to say so.
12:34So how does a crazy person prove a case?
12:36It's hard to say.
12:38Well, I'm asking you.
12:40With evidence.
12:41See, that's a good question, isn't it?
12:43Going inside the courtroom.
12:44You walk in there three months later and I wrote down what you said.
12:47Might be possibly from your bathroom, but you're asking me to find conclusively that
12:53it's from their bathroom.
12:54Well, listen.
12:55That's one.
12:56When I look at your medical records that you've handed me, you understand that what I am reading
13:00about is an ingrown toenail and hyperkeratotic lesions.
13:07Hyperkeratotic lesions are excessive corns.
13:12So, that, you know, ends up causing a very dry part that I guess that they have to take
13:17off or whatever.
13:18But how is that something that even standing bar water, bathroom water could cause?
13:23Well, listen.
13:24All I'm saying is that the problem that I had with my foot did not, didn't start until
13:30after.
13:31Okay.
13:31Now, when I say the problem, excuse me now, I'm not talking about whatever is on the foot.
13:36I'm talking about the itching and the pain that caused in my foot.
13:40It will wake me up out of my sleep.
13:41Is the first time you go to the doctor October?
13:43Because that's a long time after you were at the bar.
13:45I went to the doctors in October because by the time they first had to eliminate the person.
13:49Do you have any medical records to show that you visited a doctor for a foot problem before
13:53October?
13:54I have, yes.
13:56You have them right there, Rob.
13:57No, I have, I have bills.
13:59Bills are not the same as medical records.
14:01Bills just say.
14:01Well, when you say medical records.
14:03Yeah, I mean medical records.
14:04I mean something from a doctor that says what's wrong with you.
14:07Well, that's, that's why they had me to see the foot doctor because I didn't know what
14:12was, what was really wrong.
14:13Do you have, is it, does any doctor say that this happened as a result of contact with bathroom
14:18water or with water in a bathroom or with water at all?
14:21Well, I mean, if you understand what I'm saying, I know you're mad and you're yelling, but I
14:25need you to hear me though.
14:25Okay.
14:26The medical records you've handed me say you have ingrown, an ingrown toenail that is infected
14:30and in October.
14:31Probably from the water.
14:32You think from the water?
14:33Probably from water eight months earlier?
14:34Probably not.
14:35No, no.
14:35And listen, and that you have excessive corns.
14:41That's what, that's what.
14:41I don't have those now.
14:43Okay.
14:43I understand.
14:43But that's the medical records you brought me.
14:45If you have something else.
14:46I don't have a doctor saying that's from water in their bathroom or something close
14:50to that.
14:51That's from.
14:51I don't have anything saying the doctors, all five doctors that I've seen that did not
14:56really say that because I didn't ask them to write that down.
14:59Okay.
14:59Because when you got.
15:00How am I going to find that it's as a result of a single visit that you had to the
15:05bathroom, be it number one or two back in two years ago, how am I going to find that
15:10it's as a result of sitting there?
15:12And then you're telling me that you're sitting there and your, your suede shoes are getting
15:16drenched, but you continue to let them dry.
15:18I had to get finished with the toilet.
15:20I had to get finished with the bathroom.
15:21I was using the toilet.
15:22Can you lift your feet?
15:23Well, I walk with a cane.
15:26I'm sitting down on the toilet.
15:27Ms. Green, based on the evidence that you're giving me, I cannot find that they owe you $3,500.
15:35I just can't write for the defendant.
15:41Well, there just wasn't enough evidence there.
15:43Step right here for the judge to ruin the favor.
15:45There's never enough evidence when it comes to me.
15:49I gotta go that way, right?
15:50No, no, no.
15:51You were going the right way.
15:52It's this way.
15:52It's this way.
15:53Right.
15:53Anything else you want to say before you go?
15:56All right.
15:56So step right over here.
15:57What's going on here?
15:59Well, the truth, the judge is smart and the truth came out.
16:03She just made up these accusations and just wanted to blame us to get some money, basically.
16:08Why would she pick on you?
16:09You guys were...
16:11Why would she pick on you?
16:12I really...
16:13She's put lawsuits on several different people.
16:16This is what I've been hearing since I've got this.
16:19Have you seen her at the bar recently?
16:22She's not allowed back in.
16:23No?
16:24No.
16:25Harvey?
16:26Okay, Kurt.
16:27Whenever there's some kind of an injury and when you need a doctor or some other kind of professional,
16:32you need to bring in an expert who can connect the dots.
