00:40Funston is 64 years old.
00:42And a Fox 40 exclusive here at 10 o'clock tonight,
00:45Rowena Shaddix spoke to the former
00:47Sacramento County District Attorney,
00:48that is Anne-Marie Schubert.
00:50She prosecuted that case
00:51and she also talked with victims who are now adults
00:54and Senator Roger Nielo,
00:56who is working now to change that law.
01:00Needless to say, I was absolutely shocked and stunned
01:02that such a decision would be made.
01:04This week, former Sacramento District Attorney
01:07Anne-Marie Schubert learned
01:08that convicted sex offender David Funston
01:11was granted an early release by the parole board on Wednesday.
01:15The age of his victims was from three years old to seven.
01:18He kidnapped them.
01:20He committed horrific sex crimes.
01:22He is a pedophile in my opinion.
01:25He's a dangerous human being.
01:27But he went to trial and he was sentenced to multiple life terms.
01:31The judge essentially said,
01:33no amount of time is enough.
01:34You should never get out of prison.
01:36And so now he has this benefit
01:38that he can now get out of prison
01:40because our legislature decided
01:42that we should let people out early.
01:44And in fact, he should never actually be released.
01:4733-year-old Amelia was Funston's youngest victim.
01:51He used a Barbie doll to lure her away
01:53from her aunt's front yard and kidnap her.
01:56Took her to his residence,
01:57committed crimes against her.
02:00She's three.
02:01She's a toddler.
02:02And then she's dumped into a neighborhood
02:04and said, go knock on that door.
02:06I remember bluntly of what happened that night.
02:10I can identify my surroundings very well.
02:14I still remember that.
02:15I don't think that he should be out free
02:17because he's a pedophile for one.
02:19And that's a dangerous man.
02:21He's a monster.
02:22That's scary.
02:23That's a worst nightmare.
02:24I'm one of the lucky children that got away, you know, so.
02:28Absolutely.
02:28And I'm blessed to be able to stand here today
02:31at the age that I am to be able to speak about that.
02:34Another of Funston's kidnappings
02:36involved two sisters, ages five and six at the time.
02:40Fortunately, the girl's upstairs neighbor
02:42witnessed the kidnapping
02:43and yelled at Funston to release the girls
02:45because she had his license plate number.
02:48He then let them out of his car
02:50after driving only a few feet.
02:52He still got convicted of the kidnapping.
02:54Good.
02:54But that was because she got the plate.
02:56That's what led us to him.
02:57That's what led law enforcement to him.
02:59Fox 40 spoke to the older sister
03:01who says they pray he isn't released from prison
03:04and that her and her sister are blessed to be alive.
03:08This is the case that demonstrates
03:09that this law needs to be changed and to be fixed.
03:13Senator Roger Nilo is working to fix it.
03:16He submitted SB 1278.
03:19The bill will propose
03:21that under the existing circumstances,
03:24there will be certain crimes
03:27that will be excluded from consideration.
03:30At the very least, sex crimes.
03:34And we will assess.
03:36I think it should be broader than that.
03:37But I want this.
03:39This is not a messaging bill for me.
03:41I want it to be successful.
03:44There's just no excuse
03:45for that kind of leniency
03:47given that kind of crime.
