00:06You, sir, had been collecting baseball cards and football cards since you were a child.

00:14And you took his baseball cards and sold them to the defendant, who has a store.
00:20Correct.
00:21You want the cards back.
00:22Yes.
00:24So you're an important part of this case, Mrs. Costa.
00:27Now, I assume from my reading of these papers that you and your husband had discussed selling the baseball cards.
00:36Is that right?
00:37We had discussed going to this, just going somewhere and finding out their value.
00:42The garage had flooded, and I was thinking, well, if they're just going to get molded or ruined in the garage,
00:49maybe we should see if they're worth anything.
00:52So you had a discussion with your husband?
00:54Yes.
00:54We brought them into the house.
00:55And tell me about the discussion that you had with your husband.
00:59That was about the extent of it.
01:00And I went to the shopping center that we frequent all the time.
01:04I've been in the defendant's store a couple times.
01:07I told him I might bring him by.
01:09I bought a Nebraska football, a couple baseball hats.
01:15Just felt familiar with it.
01:17Asked him if he would look at the cards.
01:18He agreed.
01:19And you were discussed with your husband, the fact that you were going to take them in to have him look at the cards.
01:24I mentioned it.
01:26And what did your husband say to you?
01:29I don't remember anything in particular that he said to me.
01:32He didn't say, don't sell them or anything.
01:37It would seem to me that if two people were having a discussion about baseball cards,
01:43an extensive collection of baseball cards, that you, sir, would have had some indication of their value.
01:51Is that right?
01:52Yes, Your Honor.
01:53And it would also seem to me, logically, that you would have shared that with your wife.
01:59Yes, Your Honor.
02:00So, what did you tell her that you thought the cards were worth?
02:04We didn't discuss the value of the cards.
02:07The cards had never been appraised.
02:09And when your wife told you that she was going to take them in,
02:11are you trying to tell me, sir, that you didn't tell your wife,
02:14I think that this is what the cards are worth?
02:17No, she's only going to show them.
02:19And I knew there were valuable cards.
02:21There was a misunderstanding.
02:22And I didn't have intention to sell them when I went in that day.
02:25I wanted to see what they were worth.
02:27By the time I left his store, I went in, he thumbed through them real quick,
02:33showed me all the little deformities, oh, the corner's bent, et cetera, et cetera,
02:38said there's not really anything of a lot of value here.
02:42There's some bulk value.
02:43I'll give you a couple hundred.
02:44I paused.
02:44He said, how about 300?
02:46I tried to call my husband from the store, and I got his voicemail at work.
02:51I had a conversation with his wife.
02:53His wife is there while this was happening.
02:54And I said, well, we've been in your store before.
02:58I said, is this about the same that somebody's going to give me down the street?
03:01Because I thought if they're worth a lot, like $1,000, $1,500, I would take them some,
03:05you know, a couple places.
03:07The minute I walked in the door when I got home, my husband called.
03:09I said, I sold your cards.
03:12And he flipped out.
03:13He said, what?
03:14I can't believe it.
03:15He didn't even want to know how much I sold them for.
03:17And he went over there within the hour and...
03:22You mean within the hour of you selling the cards to him?
03:25Yes.
03:25They still had them out on the counter when my husband went back into the store.
03:29Okay.
03:30Mr. Levine, up until this point, nobody is faulting you.
03:35And I wouldn't even fault you subsequently.
03:39Because you had somebody who came in who had what we call in the legal business
03:44apparent authority to sell those cards.
03:47Right?
03:49You had the cards.
03:50You had gone in a couple of days before.
03:52You were the one who said, I want to bring some cards in for you to see.
03:55You didn't say that these are my husband's cards.
03:58I don't have the right...
03:58No, I told them that they were my husband's cards.
04:00Did she tell you they were my husband's cards?
04:02I believe she did tell me.
04:03Well, did you?
04:04Oh, she did.
04:05That's an important piece.
04:06So, Mr. Levine, at that point, sir, that puts you on notice.
04:14And it puts you on notice that she may not have the authority to sell those cards.
