00:11Pero piracy doesn't just give you a cheap book.
00:15It robs our authors, kills creativity, and even puts consumers at risk.
00:22Kaya ngayong National Book Week, mas intendingin po natin ang epekto ng ganito mga gawain
00:26sa ating mga manunulat at publishing industry.

00:56Let's talk about book piracy.
00:58Gaano po ba kalaking epekto po ng book piracy ngayon sa publishing industry dito po sa ating bansa?
01:07Unfortunately, wala tayong national data kung ano, gaano kalaki ang epekto ng book piracy sa ating bansa.
01:14But we can gauge the extent of book piracy with a recent survey, 2024 survey that says
01:2470% of our online, yung mga nag-online ay umamin na nag-access sila or nag-download sila ng pirated materials
01:40kasama na dyan ang libro.
01:43We are only second to Vietnam in terms of this number.
01:47Alright, Sir, you've mentioned also the different, although we don't have really the data, pero baka meron din tayo nito, Sir.
01:55Gaano po ba karami yung piracy and counterfeiting reports ang natanggap nyo at paano po ito ina-address?
02:02Yung intellectual property office, sa pamamagitan ng aming IT enforcement office,
02:12ay kumatanggap nga ng mga complaints sa mga piracy or counterfeiting na nakikita natin online.
02:20And based on the data that we have, ang isa sa pinaka-counterfeited or pirated na material ay ang books,
02:32kasama nyo dyan din ang movies.
02:34Pagdating sa books, nandyan yung ating educational books na pinaka-mating din na papirate.
02:42Alright, so Sir Emerson, nabanggit nyo na ginagawa ito online.
02:45So, as a reader or sa publiko po, paano po nalalaman kung yung article na binabasa nila
02:52or yung libro na binabasa nila online is counterfeited or pirated?
02:58Pag sinabi kasi natin piracy, ito ay unauthorized reproduction, sharing, or distribution of literary work
03:12in this particular case, ang libro.
03:15So, paano natin malalaman?
03:17Madaming sinyales yan.
03:19Nandyan ang example, yung tinatawag natin na book alike.
03:25I'm sure nung polegyo tayo ay maka-experience na tayo ng ganyang encounter with book alike.
03:33Na yung isang libro is photocopied without the permission of the author or the publisher
03:39and then it's being sold or marketed as an original copy of the book.
03:44Yan po ang counterfeiting po, counterfeit books ay isang uri ng piracy, book piracy.
03:53Nandyan din yung pinatawag natin na photocopie.
03:57Madalas ayaw na natin bumili ng urihinang na libro and then pinopotocopy na lang natin.
04:03Yan, photocopie is generally also considered as book piracy.
04:08Nandyan din yung unauthorized scanning.
04:11So, halimbawa, meron kang libro or libro yung kaibigan mo,
04:15i-scan mo lang yung libro and then pipdf mo siya and then isi-share mo siya lalo.
04:20So, those are all activities related to or that can be considered as book piracy.
04:28Well, Sir Emerson, how do we put a stop dito sa book piracy?
04:32Siguro maganda makipag-ugnayan tayo rin sa mga schools,
04:36even as more na sa mga photocopying centers.

04:46So, ang intellectual property office, sabi ko nga ay may dalawa,
04:54let me highlight two major programs of the office pagdating sa counterfeiting and piracy.
05:02Ang isa po diyan ay ang tinatawag na voluntary administrative site blocking.
05:07So, kung kayo po ay alam nyo or kayo ay copyright holder,
05:13kayo ay author or simple user lang po kayo,
05:17maaari po kayong dumulog sa IT enforcement office
05:21para isumbong ang incidences ng book piracy na nakikita natin o na-obserbahan natin.
05:28And if, for example, a particular site is a pirate site,
05:34talagang wala siyang ibang purpose kundi ma-distribute at ma-reproduce at ma-share
05:40for commercial consideration ang isang libro na walang pahintulat ng author or ng publisher,
05:48ay pwede rin siyang i-complain sa aming voluntary administrative site blocking.
05:54At mabilis, makikipag-ugnayan tayo sa mga platform.
05:58Meron tayong mga internet service providers
06:01that are part of the memorandum of agreement with the intellectual property office
06:07para ma-block yung site, yung pirate site na sinasabi natin.
06:12Ang pangalawa po diyan na effort ng I-Pofill
06:15ay ang tinatawag natin na e-commerce platform.
06:18So pag may na-observe po tayo sa mga social media, marketing, marketplaces
06:25na merong nangyayaring book piracy,
06:31then pwede rin pong i-report doon sa mismong platform, e-commerce platform
06:40para ma-take down naman yung content na yun na minomarket na book, pirated book.
06:49Alright, sir, aside from the other stakeholders mentioned kanina,
06:53we also have our Filipino publishers and authors.
06:56Kamusta po ang ating participation sa kanila?
06:59Ano po ang nabanggip dito?
07:01Ang, in fact, our anti-piracy efforts are in coordination with the National Book Development Board
07:15and we are also in close coordination even with the National Library of the Philippines.
07:21So sa NBDB po, yung National Book Development Board,
07:27kasama po natin siya sa NCITR,
07:31kung tawagin natin yung National Committee on Intellectual Property Rights.
07:36Ito po ay a group po ng mga government agencies
07:39that are in charge of combating piracy and counterfeiting in the market po.
07:46And then, yun po, we also coordinate with the National Library
07:51for certain awareness programs and even agencies like the Department of Education po.
07:58Sir Emerson, curious na ako kasi back in college,
08:00may mga haklase po ako, isan ako din po,
08:03na hindi kayang bumili ng original na libro.
08:06Tapos kailangan nila sa mga lessons.
08:08So, do we discourage universities or colleges or mga estudyante
08:13na mag-photocopy ng chapter ng mga libro na yun?
08:17Or okay lang ba pagka-chapters lang ng mga libro,
08:19ang pinaka-photocopy, hindi naman buong libro?
08:24Doon po tayo sa general rule, sir.
08:27Ang general rule is when you reproduce or copy a book
08:34or even a substantial part of the book that is considered as copyright infringement.
08:42Ito ay paglabag sa karapatan ng isang author or publisher,
08:46kung sino man yung may-ari ng copyright nito.
08:49Ang exception na naandun sa ating batas
08:52ay ang paggamit or pag-photocopy ng small portion,
08:57hindi substantial portion,
08:59but small portion of a work
09:02for research purposes and educational purposes.
09:08Okay. Pwede namin pala.
09:10Uy, bilang pag-respeto na rin yun sa ano, siyempre,
09:12sa intellectual property mismo ng isang author
09:15na pinag-irapag gawin yung kanyang libro.
