Fact check: Has Marine Le Pen's appeal against her presidential ban been denied?

The far-right leader has vowed to exhaust all legal avenues to overturn her five-year ban from public office. Where does she stand in efforts to appeal her sentence?

00:00Has Marine Le Pen's presidential ban appeal been denied?
00:07Misleading posts circulating on X claim that Marine Le Pen,
00:11leader of France's far-right National Rally Party,
00:14has been blocked from running in the 2027 presidential election for good,
00:19after a court rejected her appeal against her embezzlement conviction.
00:23Back in March, Le Pen was sentenced to a five-year ban in public office,
00:27effective immediately, among other penalties,
00:29after she and several other members of the RN were found guilty
00:33over a European Parliament fake job scheme.
00:36This post on X says that the French are outraged about her alleged appeal rejection
00:40and that her support stands at 37.5%.
00:43It also says that Jordan Bardella will now replace her in the presidential race
00:48before blaming the EU for being behind Le Pen's ban.
00:51However, the claim about the appeal is wrong and requires a bit of legal untangling.
00:55The Council of State, France's highest administrative court,
00:59did reject a challenge to her ban on the 15th of October,
01:02but this isn't the same thing as her appeal against her criminal conviction.
01:06French legal experts told The Cube the challenge targets the decision
01:10to strip Le Pen of her seat as councillor,
01:12a step taken to argue her overall sentence might be unconstitutional.
01:16The Council of State ultimately rejected her argument,
01:19so it's true in a sense that an appeal against her ban has been thrown out.
01:23But it's wrong to suggest that Le Pen's 2027 presidential hopes are now over.
01:28The separate and larger appeal against her criminal conviction is scheduled to begin in January.
01:33If she wins there, then her ban will automatically be lifted.
01:37As for the Post's other claims, yes, Le Pen and the RN are popular in the polls,
01:41putting them and Jordan Bardella between 33% and 37%.
01:46But no, the EU is not behind Le Pen's conviction.
01:49Despite the European Parliament blowing the whistle on the embezzlement scheme,
01:52the case fell entirely under the French judiciary.
