00:37ano po ang naging proseso sa pagpayag niya na maging testigo laban kay dating Pangulong Duterte?

01:43Ang inaalam lang po namin yung mga arrangements po nila and to make sure that she is safe and protected here in the Philippines.
01:51Well, Asek, ano naman ang mga konkretong hakbang ng DOJ upang masiguro ang kaligtasan ni Garma bilang testigo,
01:57lalo na't nabanggit, uniform personal pala, mga posibleng kalaban nito.
02:03Yes po, itong pagdating po niya last Saturday, after she was cleared by immigration,
02:11dahil po wala naman po siyang warrant of arrest,
02:13ay pina-escort po natin ng mga tag-NBI, si former Colonel Garma, doon sa kanyang tahanan.
02:21And the next day, nung in-advise po siya ng ICC na kailangan muna siyang umalis din ng bansa kaagad,
02:30ay pina-escort din po natin si former Colonel Garma sa airport.
02:36And si NBI director po mismo ang kasama niya po doon para malaman po yung next na mga hakbang
02:45and how to still keep the open communication between the Philippine government and her
02:51if in case na manganib po yung buhay ni former Colonel Garma.
02:55So, yun po yung mga hakbang na inano namin sa DOJ
02:59and we hope that she continues to be safe despite being in another country.
03:05Asek, ano naman po ang magiging efekto ng pagiging testigo ni Garma sa ICC
03:10sa kanyang pananagutan sa kasong kriminal na isinamba po ng NBI
03:15kaugnay sa pagkamatay ni Wesley Barayuga?
03:20Well, yung kay Wesley Barayuga po is, sa tingin po namin, is a part of a whole.
03:27Yun pong kaso na yun ay iisa lang.
03:30Ngunit sa ICC, ang kailangan kasi nilang i-prove doon ay isang pattern
03:34of widespread killing where they used state machinery.
03:41Kaya siguro po, if you look at it in the lens of a microscope,
03:49itong kaso ni Barayuga ang makakita mo, which we are processing
03:53and it's still under preliminary investigation here in the Department of Justice.

04:30or makakalimutan ang kasong ito habang nakatutok din naman sa kanyang testimonya sa ICC?
04:38Well, sa amin po, we are focused on what is before us.
04:43At dalawa po yan with regards to the ICC.
04:46Itong case po ni Wesley Barayuga, in which case na submitted na po for a solution ang kaso na yun.
04:53So, in a few days or weeks, we will see what the decision is by the panel of prosecutors in that case.
05:00At pangalawa po, tinitigan po natin yung kaligtasan ni former Colonel Garma,
05:05which is our obligation to the ICC in terms of this case.
05:12Asek, posible po bang magsilbing state witness si Garma,
05:15hindi lamang sa ICC, kundi pati rin po dun sa mga lokal na kaso dito sa bansa?
05:23Of course, ma'am, there is always that possibility.
05:27Kaya lang po, kailangan muna niyang ilatag yung information sa atin ng maganda.
05:35There has to be somebody who is more guilty than her in the case.
05:40Dahil isa po yan sa mga requirements para ma-discharge as a state witness.
05:45The person who is discharged as a state witness, hindi po pwede siya ang most guilty sa kaso.
05:51So, hanggat hindi po siya maglatag ng mga pangalan na mas guilty sa kanya,
05:58yung mga umuto sa kanya na mga ganitong bagay,
06:02we cannot consider her as a state witness yet.
06:04However, if the time comes at meron po siyang masabing mga pangalan na mas malaki sa kanya
06:12and who have more of a direct involvement here,
06:15then it is possible to consider her for witness protection and the state witness.
06:21Well, dito po sa DOJ, Yusek, we've always been and will always be evidence-based.
06:49Hindi po tayo gagalaw at yun po talaga ang policy ni Secretary Remulia
06:54na hindi po kami talaga gagalaw kung wala po kaming ebidensya na hinahawakan.
06:58And the evidence that we hold is not mere probable cause anymore.
07:02We are pushing for that threshold of reasonable certainty of conviction.
07:07Kaya we put upon ourselves the responsibility na kumuha ng magandang ebidensya
07:14para sa lahat ng kaso na tinefile namin sa korte.
07:16So, hindi po nangyayari ngayon sa bagong administrasyon ni Secretary Remulia
07:21na pwede tayo pumili kung sino ang kakasuhan at kung sino hindi.
07:26Basta nakalatag po ang ebidensya
07:27and it reaches the threshold na reasonable certainty of conviction,
07:32lahat po yan, tinefilean po natin ang kaso.
07:35So, with regards to playing politics,
07:39that is something that you should not expect from the DOJ
07:42under the leadership of Secretary Remulia.

07:51bago i-consider ang pagbibigay ng immunity
07:53sa mag-asawang Pasifiko at Sara Diskaya?

08:08wala po silang choice na magbigay ng amount sa DPWH officials,
08:16kung sino man ibang officials ng government.
08:21Pero sa tingin po kasi natin,
08:22ito po ay isang conspiracy kung saan
08:25before the implementation of the project,
08:29alam na po nila kung ilan
08:30o magkano ang mga amounts na ihahati nila.
