00:00it was just an ordinary tuesday afternoon when the letter arrived a crisp white envelope with
00:05the hoa's official logo stamped on the front i had been dreading this moment ever since i saw
00:11the neighborhood facebook group buzzing with stories about the new parking rules the hoa had
00:15started enforcing but i never imagined it would be me the one getting slapped with a 500 fine for
00:22parking in my own driveway i stared at the letter for what felt like minutes disbelief mixing with
00:28frustration violation notice unauthorized parking in driveway the words jumped off the page glaring
00:36back at me as if accusing me of some grave wrongdoing the letter claimed i had violated the community's
00:42parking guidelines by leaving my car in the driveway overnight something i'd been doing
00:46without issue for years my first thought was how could this be legal my driveway was part of my
00:54property if anyone had a right to park there it was me but the hoa had different ideas they said it
01:02was against the rules and that fines would be imposed to maintain community standards i took a deep breath
01:08and re-read the letter the fine was 500 payable within 30 days or they would add late fees and
01:15possibly take legal action the tone was stern bordering on threatening i felt anger bubbling up
01:22how could they be so unreasonable was this some sort of power trip i looked out the window at my driveway
01:28where my blue sedan sat peacefully innocent and unoffending it was just a car in a driveway nothing
01:36more curiosity pushed me to dig into the hoa's bylaws online there it was buried in the fine print
01:45no vehicle may be parked in the driveway between the hours of 10 pm and 6 am without prior approval from the
01:50board no approval had been sought or given obviously but the rule had never been enforced before at
01:58least not on me i thought back over the years and realized i'd seen dozens of neighbors doing the same
02:03thing kids leaving their cars outside overnight people coming home late and parking in their driveways
02:10none of them seem to have gotten a ticket was i being singled out and if so why the more i thought
02:17about it the more it felt like harassment the hoa had always been a background nuisance sending notices
02:23about lawn heights trash can storage and christmas decorations but this was something else this was an
02:31attack on my right to use my property determined not to be intimidated i took to the neighborhood
02:36facebook page to ask if anyone else had received a similar fine to my surprise several residents
02:42responded that they had indeed gotten fines for minor or questionable infractions over the past few
02:48months one lady was fined for having a bird feeder another for leaving a trash bin out an hour too long
02:55it seemed the hoa was cracking down but selectively my mind raced with questions was this legal could
03:03the hoa really do this was there a way to fight back that night i took a walk around the neighborhood
03:10camera in hand i wanted to document what i saw driveways full of cars some even blocking sidewalks
03:16slightly no tickets on any of those vehicles just me i also noticed subtle things the hoa president's
03:25house was the only one with a freshly painted fence installed without the usual approval process
03:31i made a mental note of that back home i drafted an email to the hoa board politely requesting
03:38clarification on the violation i asked if the rule was new why it was being enforced now and why i
03:44was singled out days passed with no reply then came the next letter a reminder pay the fine or face further
03:53action i was done waiting the fight was on the weekend came and i was still fuming over the violation
04:01letter i hadn't paid the fine not yet and the longer i stared at the envelope the more i felt like i was
04:08being baited into a fight i hadn't signed up for but if it was a fight they wanted it was a fight they
04:13would get my first step was to attend the next hoa meeting i hadn't ever gone before most residents
04:20didn't the meetings were held every first monday of the month at the community center the same beige
04:26building where we held holiday potlucks and neighborhood bingo nights that monday i showed up
04:3110 minutes early there were six people already seated an elderly couple who always wore matching
04:37windbreakers a young mom with two fussy toddlers and a balding man wearing a shirt that read hoa or
04:44homeowner oppression agency i liked him already gerald our beloved hoa president sat at the front of the
04:52room sipping from a starbucks cup and pretending to read over documents next to him were the other board
04:58members marcia the secretary luke the treasurer and two others whose names i couldn't remember
05:05i introduced myself and politely said i wanted to raise a concern during the open forum marcia
05:11smiled tightly and told me i'd get three minutes as per procedure i nodded suppressing the urge to
05:18mention that my driveway fine cost more than some people's car payments when it was my turn i stood
05:24before the room and explained what had happened i even passed around a printout of the violation notice
05:30i'm just asking for clarity i said why am i being fined for something half the neighborhood does every
05:35night if this rule is being enforced it should be applied equally the room was quiet for a moment
05:42before gerald cleared his throat mr turner the rules are clearly outlined in the community bylaws
05:49the driveway parking clause exists to maintain visual order and discourage overnight loitering
05:54or unregistered guests i pressed on then why aren't others being cited gerald's expression tightened
06:03we don't have the manpower to issue a citation to every offender every time your case was simply the
06:08one reported reported by whom that information is confidential i looked around the room a few neighbors
06:17nodded sympathetically others looked uncomfortable carol who had come in late mouthed unbelievable from
06:24her seat the rest of the meeting was uneventful but something in gerald's tone stuck with me a hint
06:31of smugness maybe even amusement i didn't like it afterward i lingered in the parking lot and chatted with
06:38the man in the hoa oppression shirt his name was kevin he lived on maple drive and told me he'd fought
06:45the hoa last year over a bird feeder that supposedly attracted undesirable wildlife they pick targets
06:52he said they see someone who doesn't show up to meetings or doesn't volunteer for committees and
06:58they test how much pushback they'll get if you roll over they keep going so what did you do i asked
07:05i documented everything took photos filed complaints talked to neighbors eventually i exposed one of the
07:12board members for approving her own backyard renovation without submitting plans the hoa backed
07:18off that was all i needed to hear the next two weeks were a whirlwind of research observation and
07:25strategy i was no longer just a guy who got fined i was a man on a mission the hoa had picked the wrong
07:32resident to bully first i bought a small dash cam and pointed it out the front window of my home
07:39every night it recorded footage from 11 30 pm to 6 30 a.m capturing who parked where and for how long
07:46by the end of the week i had over a dozen clips showing various neighbors parking overnight in their
07:51driveways including gerald himself his silver mercedes was parked halfway into his driveway for three nights
07:57straight i printed out still images time stamped them and labeled them with addresses my plan wasn't to
08:05rat out my neighbors it was to expose the hypocrisy then i requested the hoa's meeting minutes from
08:12the past year citing my rights as a dues-paying member i found discrepancies fines issued unevenly
08:20board decisions not properly recorded one line from a march meeting stood out discussed initiative
08:26to improve neighborhood visuals recommended targeting habitual violators with minor but enforceable
08:32penalties targeting that word again i compiled a full report and delivered it to the hoa office
08:41hand delivered signed for with a copy emailed to each board member then i filed a formal dispute of the
08:47fine but i didn't stop there i started talking to neighbors i shared my story turns out several others
08:56had been fined for minor violations in the past six months lawn height trash bins not brought in on time
09:02decorative flags all selective all questionable so we formed a group chat cedar pines watchdogs
09:11within days we had 20 members people were angry and for the first time they weren't alone it all came
09:19to a head in august the next hoa meeting was scheduled and i arrived with more than just screenshots
09:25and paperwork i arrived with backup 20 neighbors stood with me as i addressed the board i laid out the
09:32evidence selective enforcement misuse of rules and even gerald's own violations i played a short video
09:40showing his mercedes parked overnight the room went silent i'm not asking for revenge i said i'm asking for
09:48fairness some board members looked shaken marcia flipped through her notes nervously gerald for once
09:56had nothing to say that night the board voted to suspend all outstanding parking fines and review
10:02enforcement procedures a few weeks later gerald resigned for personal reasons and as for me the fine
10:10was dropped but i wasn't done yet in the months that followed the watchdogs became an official community
10:16group we held bbqs organized cleanup events and proposed changes to the hoa charter we weren't anti-hoa
10:26we were anti-abuse we wanted transparency respect and rules that made sense and you know what it worked
10:35more residents started attending meetings a new board was elected one that listened the driveway rule
10:42repealed unanimously and every time i parked in my driveway after that i did so with a grin
10:48because in the end they tried to find me into silence but i parked myself right in their way
