00:03On 7 March 2025, pre-trial Chamber One concluded that there were reasonable grounds to believe
00:12that Mr. Duterte is criminally responsible pursuant to Article 25.3A of the Rome Statute
00:22as an alleged indirect co-perpetrator for the crime against humanity of murder pursuant
00:30to Article 7.1A of the Statute as follows.
00:36A. Murder of at least 19 persons, allegedly drug pushers or thieves, killed by members
00:44of the Davao death squad in various locations in or around Davao City, Philippines, between
00:522011 and 2016.
00:57B. Murder of at least 24 persons, allegedly criminals, such as drug pushers or thieves
01:06or drug users, killed by or under the supervision of members of the Philippines law enforcement,
01:14sometimes with the assistance of persons who were not part of the police, at various
01:20locations in the Philippines between 2016 and 2019.
01:32Thank you, Madam Courtroom Officer.
01:36Mr. Duterte, I'm not going to ask you to stand up because I know your condition, so I'm going
01:42to allow you to remain seated.
01:44You have just heard the reading of the charges, which are in accordance with the content of
01:50the arrest warrant you received.
01:53This means that you have been informed of the crimes of which you are accused.
01:58And this concludes the examination of the first point mentioned above.
02:02I will now turn to the second point, which concerns your rights as a suspect before this
02:08court.
02:10I will summarize some of these rights, which are of particular importance at this stage
02:15of the proceedings.
02:18Those rights are as follows.
02:21You can benefit from the assistance, free of charge, of a competent interpreter and
02:26benefit from the necessary translations to meet the requirements of fairness.
02:34You have the right to have the time and facilities necessary to prepare your defence and to communicate
02:43freely and confidentially with the counsel of your choice.
02:49You have the right to remain silent and you cannot be forced to testify against yourself
02:57or to confess guilt.
03:00You can also make statements in your defence without taking an oath.
03:07In addition to any other disclosure provided for in the statute, the prosecutor must disclose
03:15to you, as soon as practicable, evidence in his possession or at his disposal that shows
03:25or tends to show your innocence or to mitigate your guilt, or that could undermine the credibility
03:33of the evidence against you.
03:36At the confirmation of charges hearing, you can contest the charges, challenge the evidence
03:41presented by the prosecutor and present evidence.
03:45There will be no trial if the charges are not confirmed or if the proceedings against
03:50you are completed.
03:51You have the possibility to make an application for interim release pending trial.
03:56And finally, Mr. Duterte, you have the right to be informed as soon as possible and in
04:01detail of the nature, cause and content of the charges in the language that you fully
04:10understand and speak.
