27 साल से जेल में बंद कैदी को है रिहाई का इंतजार, सुप्रीम कोर्ट से भी नहीं मिल सकी राहत

00:00There are two types of prisoners in the jails. One is a convict and the other is an under-trial.

00:05Under-trial prisoners are those whose cases are long in the courts.

00:10Either they have appealed somewhere or their case is going on.

00:14In the present situation in Jabalpur jail, there are 1400 convicts and about 1800 under-trial prisoners.

00:23Most of the under-trial prisoners are 3 to 5 years old.

00:27But here in Balaghat, Shiv Chandan Dehle is also a convict.

00:32He has been in jail for the past 27 years and his case is still pending in the court.

00:38Actually, Shiv Chandan Dehle reached jail for the first time in 1996 and has not been released since then.

00:48He is still standing in the Madhya Pradesh High Court with his appeal.

00:53Shiv Chandan Dehle has two accusations.

00:56The first accusation is of 1996, in which there was a ruckus in a village and a man was killed.

01:03In which, along with Shiv Chandan, five other accused were also punished.

01:09But the Supreme Court released all the other accused.

01:14But Shiv Chandan remained in jail. He was not pardoned.

01:19The second time, a dangerous criminal was killed in jail.

01:26In which, Shiv Chandan was locked in another barrack.

01:30But despite that, he was made an accused.

01:33In this way, he was accused of two murders.

01:36Although, the partnership of Shiv Chandan is not clear in both.

01:41But despite that, he has been in jail for the past 27 years.

01:46An advocate of Jabalpur, Brijesh Rajak, believes that Shiv Dehle is innocent and he should be released.

01:55That's why he took this case without money.

02:00Brijesh Rajak says that Shiv Chandan Dehle is in jail because of the wrong policy of the jail.

02:11In 2015, he filed a case in the W.P. Honorable High Court.

02:18In which, the jail administration betrayed him and withdrew the appeal in the Supreme Court.

02:24In which, the other four accused were acquitted by the Supreme Court.

02:36If Shiv Chandan Dehle's case was not withdrawn, then Shiv Chandan Dehle's case would have been acquitted.

02:41And Shiv Chandan Dehle would have been released.

02:45Meanwhile, in 2015, Shiv Chandan Dehle was punished for the jail murder case.

02:50Immediately after the punishment, Shiv Chandan Dehle appealed in the W.P. Honorable High Court.

02:54After hearing the case from the W.P. Honorable High Court, Shiv Chandan Dehle was immediately put on bail.

03:13He was released on bail.

03:20In the jail murder case, Shiv Chandan Dehle was released on bail.

03:28According to Shiv Chandan Dehle's custody certificate, Shiv Chandan Dehle has been sentenced to 26-27 years.

03:35And according to the remission, Shiv Chandan Dehle has been sentenced to 40-42 years.

03:40If Shiv Chandan Dehle would have been punished more, then how long would he have been in jail?

03:46Shiv Chandan Dehle was initially punished in 1998.

03:51According to that case, Shiv Chandan Dehle was punished in 2012.

03:55And in 2013, Shiv Chandan Dehle was released on bail.

04:02He was sentenced to 14 years.

04:08Sir, Shiv Chandan Dehle has been in jail for 27 years.

04:14Why has Shiv Chandan Dehle not been released on bail?

04:18Shiv Chandan Dehle has not been released on bail for 27 years.

04:21He would have been serving both the sentences.

04:24But let me clarify one thing.

04:26The policy of the government, which was introduced in the form of CRPC-433,

04:33which gives power to the government to reduce the sentence of a person,

04:38in that context, policies are made, committees are formed, and rules and regulations are made.

04:44So, these policies have been made.

04:46It was introduced in 2008, 2012, and now it has been introduced 2-3 years ago.

04:49In this new policy, that is, CRPC-433, the government has formed a committee at the district level.

04:55That committee goes up and is approved by the government.

04:59In this, the government has given clear instructions on how to take prisoners.

05:04So, the prisoners who are in double murder in this policy,

05:10those prisoners have been considered ineligible under the current government policy.

05:17Due to the closure of the jail, Shiv Dehle's family has come to the streets.

05:21Both his daughters have not been able to get married.

05:23They have been in jail for the past 27 years.

05:26And the family is in dire need.

05:28Now we have to see what the High Court orders the Jail Administration on 15th January when this case is heard in the High Court.
