The Privy Council is set to make a decision on whether our Court of Appeal can review judgements on bail applications for murder. The case is being taken to the Privy Council by a former Attorney General, Anand Ramlogan in light of a 2023 judgement denying six police officers bail on murder charges. Rynessa Cutting has more.

00:05Court of Appeal can review High Court judgments as it relates to bail
00:09applications for murder. The Privy Council will have to decide if judge of
00:17our High Court refuse your bail on a murder charge whether the Court of
00:22Appeal or our Court of Bail has jurisdiction to hear the matter and overturn
00:28the or confirm the judge's decision. What the state is against once the court
00:36that's a first instance judge deals with the matter you cannot go to the Court of
00:43Appeal that is the end of the matter and we went to the Court of Appeal and two
00:48judges said the state is right that we cannot appeal from a judge's decision and one
00:54judge dissented and any matters before the Privy Council knows. The matter first
00:59arose when six policemen charged with murder back in 2011 were denied bail and
01:04their attorneys led by Senior Counsel Israel Khan challenged the matter in the
01:09Appeal Court while the Appeal Court upheld the ruling. Senior Counsel Anand
01:14Ramlogan is now taking the matter to the Privy Council. Senior Counsel Israel Khan
01:19says the pending Privy Council decision will set a precedent for all bail
01:24applications are treated with. The significant would be that once a judge
01:28refused your bail in our High Court you could go to the Court of Appeal if we
01:33get through and the Court of Appeal will review. The six officers who were charged with the
01:38shooting deaths of three friends in Moruga on July 22nd 2011 were eventually
01:44acquitted at trial after 12 years in custody.
01:47Khan had previously called for a special system for speedy trials for police
01:52officers accused of crimes in the execution of their duties. The legal team
01:57is preparing to seek compensation on their behalf.
02:00That is not a matter which our chambers is handling. Not because you're locked up for 12 years if there's evidence at the lockup.
02:08We are saying the evidence was spurious. When the time comes we will argue that.
02:12The six were the first group of officers charged with murder arising from the
