If you have a good reason to take someone to court,
00:03
it's rarely helpful to put off doing that.
00:06
And depending on the type of claim,
00:07
the law becomes a ticking clock for you to take action.
00:11
The laws designed to prevent any dilly-dallying
00:13
are called statutes of limitation.
00:16
A statute of limitation is a window of time
00:18
one has to initiate a claim in court.
00:21
Each state has its own time limits for bringing cases,
00:24
and there are different time limits
00:25
for different kinds of cases.
00:27
It's easy to look up these time limits on the internet,
00:30
but it's not always as easy to know when the time limit starts.
00:35
Typically, the clock starts on the day
00:36
that whatever you are suing about
00:38
happened, or the day you find out that you were harmed.
00:42
In Florida, injury, fraud, property damage,
00:45
trespassing, and oral contracts have a four-year statute
00:49
of limitation, while professional malpractice,
00:52
wrongful death, libel, and slander
00:55
all have a two-year statute.
00:57
Written contracts have a five-year limitation.
01:00
Sometimes, you can stop the statute clock on a case
01:03
and then restart it.
01:05
This is called tolling.
01:07
Tolling is allowed only for good reasons, some of which
01:10
include the accused being out of state, in hiding somewhere,
01:14
or that the accused is currently a minor.
01:17
There is also something called a statute of repose.
01:20
A statute of repose differs from a statute of limitation
01:23
because it's not related to when you first
01:25
learned you had been harmed.
01:27
A statute of repose can bar your action
01:30
even before you have one.
01:31
These statutes are designed to protect manufacturers
01:34
and their insurers from liability for accidents
01:37
that happen after the design life of the product.
01:40
Say you bought a product over 12 years ago.
01:42
Then, due to a design or manufacturing defect,
01:45
the product injures you.
01:47
In Florida, with a few exceptions,
01:49
you can't bring a claim for that injury.
01:52
Exceptions include products that are expressly
01:54
unwarranted to have an expected useful life of more than 12
01:57
years, or certain specified products,
02:00
like airplanes, railroad equipment, and elevators.
02:03
For more insight into statutes of limitation
02:05
and how they apply to your potential case,
