Accidents happen, whether you're a serial klutz or not.
00:05
Slipping and falling can happen anywhere,
00:06
at any time, to anyone, and it might not be anyone's fault.
00:12
Sometimes though, those accidents could have
00:14
and should have been avoided.
00:17
If you slip and fall on property owned
00:19
by a person or a business,
00:20
they can be held legally accountable
00:22
for the resulting damages.
00:24
And just because lawyers call them slip and falls,
00:27
it doesn't literally have to be a slip.
00:29
It could be a trip, where someone trips
00:31
over an object in their path.
00:34
It could also be a step, which is when a fall
00:36
is caused by a hole or severe dip in the path.
00:40
But there are a number of determining factors
00:42
that decide whether you have a legitimate slip and fall case.
00:45
A landowner or business must keep their property safe
00:48
and fix hazards on site as quickly as possible.
00:51
If it doesn't get fixed and someone is hurt
00:54
because of this, it is known as negligence
00:56
and can be taken to court.
00:58
Generally, an injured person needs to fully prove
01:01
four things in court when it comes to a slip and fall case.
01:05
One, the owner or business owed
01:07
what's known as a duty of care,
01:09
which means that if a store is open for business,
01:12
they are essentially inviting you into shop,
01:14
making them responsible for your experience in that space.
01:18
Two, the owner or business didn't maintain the property
01:21
with reasonable care,
01:23
consequently causing a dangerous environment.
01:26
Lawyers call this a breach of duty of care.
01:29
Three, that the person who fell was actually injured.
01:34
Lawyers call this damages.
01:36
And four, that the injury came as a direct result
01:40
of the breach of duty of care.
01:42
This is called proximate cause.
01:45
If you do win your case,
01:46
the jury decides the amount of compensation
01:49
the defendant must pay.
01:51
The compensation can include medical costs,
01:53
lost wages, disability,
01:55
and psychological or emotional distress.
01:58
Except in cases where the jury
02:00
is allowed to punish the defendant,
02:01
the jury's job is to determine just the right amount
02:04
to bring you back even,
02:05
as if the accident never happened.
02:08
If you decide to take on a person or business
02:10
in a slip and fall case,
02:12
LegalYou is there with any and all information to help you.
02:15
Always is.
