The Federal Court has dismissed an appeal by a 22-year-old man for the murder of 23 people in an arson at the Darul Quran Ittifaqiyah tahfiz centre almost seven years ago.

In a unanimous decision, Chief Justice Tengku Maimun Tuan Mat, who chaired a three-judge bench, said the conviction was safe and there was no reason that warranted an intervention from the apex court.

00:31 upheld by the Court of Appeal.
00:34 The name of the appellant, who is known as PKK-1 in the proceedings, is withheld, as
00:40 he was 16 at the time of offence.
00:43 On the issue raised by the youth's lawyer Haijan Oma that his client's defensive alibi
00:49 had raised a reasonable doubt on the prosecution's case, Justice Tenku Maimoun said the law is
00:54 clear that where there is no ill motive, the defense of alibi cannot prevail over identification.
01:01 On August 17, 2020, the High Court found the youth guilty of the murder and ordered that
01:07 he be detained at the pleasure of the young Dipertuan Agong.
01:11 The youth lost his appeal, which was dismissed by the Court of Appeal on September 11 last
01:17 year.
01:18 The High Court had also acquitted another 22-year-old youth for the murder.
