00:00 To strengthen the integrity of the H-1B registration process and minimize broad risks, the U.S.
00:08 Citizenship and Immigration Services (USCIS) has introduced a final rule for the fiscal
00:15 year 2025 H-1B cap.
00:18 This new rule implements a beneficiary-centric selection process, ensuring fairness and equal
00:25 opportunities for all beneficiaries, regardless of the number of registrations submitted
00:30 on their behalf.
00:31 Moving forward, registrations will be selected based on unique beneficiaries, reducing the
00:37 potential for fraud and ensuring equal chances for the selection.
00:42 Starting from the FY 2025 initial registration period, USCIS will require registrants to
00:48 provide valid passport or travel document information for each beneficiary.
00:54 Additionally, the final rule clarifies requirements for the requested employment start date on
00:59 certain petitions subject to the H-1B cap, allowing filing with start dates after October
01:06 1 of the relevant fiscal year.
01:08 The rule also formalizes USCIS's authority to deny or revoke H-1B petitions if the registration
01:16 contains false attestation or is otherwise invalid.
01:20 USCIS has also introduced a pre-scheduled final rule, effective after the initial registration
01:27 period for the FY 2025 H-1B cap.
01:31 The initial registration period for the FY 2025 H-1B cap is set to open on March 6, 2024
01:39 and will run through March 22, 2024.
01:43 Organizational accounts for collaboration on H-1B registrations, petitions, and associated
01:48 forms will be launched by USCIS on February 28, 2024.
01:55 Online filing of Form I-129 and Form I-907 for non-cap H-1B petitions will also commence
02:03 on the same date.
02:05 While petitioners can still file paper Form I-129 H-1B petitions, online filing options
02:11 will be available starting April 1, 2024.
02:17 USCIS Director Ur M. Jado emphasized, "The improvements in these areas should make H-1B
