00:00 The Senate also passed a resolution to appoint an executive to assist the International Criminal Court.
00:09 After that, and after passing a similar resolution in the House of Representatives,
00:13 Vice President Sara Duterte instructed the public to investigate the motive of the Congress.
00:20 Ian Cruz and Mav Gonzalez witnessed it.
00:26 After the three resolutions passed in the House of Representatives,
00:30 the government of the Philippines must now ask the International Criminal Court
00:34 to pass a similar resolution to the Senate.
00:38 In Senate Resolution 867 of Senator Risa Ontiveros,
00:41 the cases and evidence of extrajudicial killings will not be discussed,
00:46 but the executive will assist the ICC.
00:49 In February 2018, the prosecutor of the ICC opened a preliminary examination of the allegations
00:56 that Vice President Duterte and other officials allegedly incited the killings of the drug companies.
01:03 After more than a month, the Philippines abolished the Rome Statute, the founding treaty of the ICC.
01:10 In 2019, the Philippines effectively abolished it.
01:13 In 2021, the ICC's pre-trial chamber allowed the ICC prosecutor to start the investigation
01:20 into the war on drugs of the Duterte administration,
01:23 but the Philippines asked to defer the investigation.
01:27 But in January this year, the ICC allowed the prosecutor to continue the investigation into the war on drugs.
01:34 The Philippines asked to reverse the decision and again to reduce the position of the Philippines
01:39 that the ICC has no jurisdiction because the country has already invaded.
01:43 But in July, the ICC appeals chamber confirmed the authorization given to the ICC prosecutor to continue the investigation.
01:51 President Marcos said,
01:53 "Once all our talks with the ICC are over,
01:57 and as we have been saying from the beginning,
02:02 we will not cooperate with them in any way, shape, or form."
02:05 But this Friday, the President said,
02:08 "There is also a question, should we return under the fold of the ICC?
02:14 So that's again under study.
02:16 So we'll just keep looking at it and see what our options are."
02:21 Even though it is true that the last statement of the President is that the ICC has no jurisdiction in the war on drugs,
02:32 but as I mentioned earlier, it is a big and positive sign that the serious study to return to the ICC.
02:41 One of the people who is supporting the resolution is Senator Bato de la Rosa, who became the PNP chief during the war on drugs.
02:47 "Don't you speak here.
02:49 I ask you, do you believe that the justice system in the Philippines is not working?
02:55 Then why did you file a resolution?
02:58 They were allowed to enter.
02:59 We were allowed to be here."
03:01 "Are you talking to the Senator?"
03:03 "No. No."
03:05 De la Rosa is also confident that President Marcos will not enter the ICC.
03:11 "I told you that if you have a hair like this, you cannot enter the ICC."
03:18 "Yes."
03:19 "President Marcos is not going back."
03:22 "Study.
03:23 He's just being encouraged.
03:25 He's just being encouraged by the pro-ICC."
03:27 "Just being too gentleman about it.
03:31 Since there's an issue that came up, he said that he can study."
03:37 Senator Amy Marcos, a close friend of the Duterte's, wonders why he is pushing this to the Senate and the House of Representatives
03:45 regarding many more important issues.
03:47 "This is really a headache.
03:49 So they're really looking for trouble.
03:53 But President Duterte has said repeatedly, 'Bring it on.'
03:58 For me, this is a true decision of the Executive.
04:01 It means that our co-president repeatedly said that the ICC will not let him enter.
04:08 I agree with that."
04:10 "There's no one looking for trouble.
04:12 The biggest trouble for everyone is the trouble that is being brought to the heads of the criminals
04:18 and the extrajudicial killings of war on drugs."
04:23 In the House of Representatives, tomorrow, the same resolutions will be passed for the assistance to the ICC.
04:30 "That's the sense of the House.
04:32 That's what the other congressmen are trying to do.
04:35 We will have the right time in the hearings where the arguments for and against will be made."
04:43 Vice President Sara Duterte doesn't want to reveal the reasons behind the subsequent violations of the resolution in the House
04:51 that was followed by another resolution in the Senate.
04:54 "We will just leave that to the people to analyze.
04:57 I do not want to speculate on the motives of the House of Representatives."
05:02 Those happened in the middle of the transfer of alliances between the former allies of President Duterte.
05:08 VP Sara is also saying that the UNITEAM has nothing to do with this.
05:12 "Those who are fond of politics should be ashamed.
05:16 The time of politics is not yet right because 2025 is still far away and 2028 is still far away."
05:27 Duterte said that the Department of Justice will pass their position
05:33 that the Philippines should not help in the investigation of the ICC.
05:37 DOJ said that they are claiming that the ICC has no jurisdiction in the country.
05:43 "There is no need to request because the stance of DOJ has not changed.
05:48 As Secretary Mulya said, we are just studying because there are people who are speaking from the Congress
05:57 and it is our job to listen to our co-equal branch of government."
