00:37 Application for Bail, as well as the application for the police custody of Mr. Chandra Baidu Naidu,
00:47 were listed for the final arguments. Both the parties have concluded their arguments.

01:07 During the course of the argument, it was argued on behalf of Mr. Chandra Babu Naidu that
01:14 the allegation of the transfer of the money in the party fund by the prosecuting agency is unfounded.
01:22 The amount is duly accounted, audited, return has been filed before the Election Commission of India,
01:29 income tax return has already been filed, the documents were already downloaded by the investigating agency
01:36 on 6th April, 2023. They have not done anything, they have taken the false ground for seeking the police custody.
01:46 Secondly, the police custody cannot be granted after the expiry of the first 15 days.
01:52 They have not moved any application for the extension of the 15 days, before the expiry of the 15 days.
01:59 Second thing, they want to have the confession of Mr. Naidu, which is not permissible in the law,
02:07 and the police custody cannot be granted.
02:10 The bail application, we have argued that as many as 13 accused persons have been granted either the regular bail or the anticipatory bail.
02:20 The main persons have already been granted the bail, so we are also entitled for the parity of the bail by this court.
02:30 They have already made the statement in the High Court while the hearing of the other co-accused persons.
02:36 In January 2022, they are the verge of the completion of the investigation.
02:43 Despite giving the statement in January 2022, they have not concluded the investigation.
02:50 They suddenly woke up in September 2023.
02:55 They added my client Mr. Chandra Babu Naidu as a co-accused on earth, without giving him the opportunity to approach the court of law.
03:06 With their Mala 5D, they arrested him illegally.
03:10 At 11 pm, they deliberately showed his arrest at 6 am, to buy the time of 24 hours.
03:19 He was not produced before the nearest magistrate.
03:22 And they have not done anything in the investigation.
03:25 They want only to humiliate Mr. Chandra Babu Naidu and his party.
03:31 The entire case is the Mala 5D.
03:33 There is no evidence to substantiate their case and the money which was alleged to be released.
03:41 And they are relying on the note of the finance secretary.
03:44 After that note, the finance secretary along with the committee member visited the state of Gujarat
03:50 to find the credential and genuineness of the cement company and design tech.
03:55 And that committee on 7th November 2015 gave their recommendation that they are satisfied with the work of the cements in Gujarat.
04:06 They have interacted with the Gujarat bureaucrats.
04:09 And in paragraph 7 of their project report, they have made the recommendation of release of Rs. 270 crores to the corporation.
04:22 The money was transferred to the corporation.
04:25 There is no order of the chief minister for the transfer of money to either to cements or the design tech.
04:33 The money was only transferred to the corporation.
04:36 Corporation is a different entity.
04:38 Agreement was between the corporation and the private persons.
04:42 Chief minister had to do nothing with this transaction.
04:45 He is not signatory to the MOU or agreement.
04:48 So, this entire case is without base only for the purpose of the humiliation, malign his image.
04:55 And this was the argument which was advanced before the court.
