Justice Swatanter Kumar, who faces the allegation of unwelcome sexual behaviour by a law intern, did not attend office at National Green Tribunal on Monday.
Justice Kumar absented himself from NGT on health grounds.
Earlier, the Supreme Court agreed to hear a petition by the law intern, against the alleged incident of May 2011.
The top court will hear the petition on Wednesday.
