Former Yale basketball captain plans to sue school after expulsion over sexual assault claim

NEW HAVEN, CONNECTICUT — The former captain of the Yale basketball team plans to sue the school over his expulsion for an alleged sexual assault.

Former senior Jack Montague has hired attorney Max Stern of Todd and Weld to represent him. Stern issued a statement Monday through public relations firm Polaris Public Relations.

The case stems from an October 2014 incident where a Yale undergraduate accused Montague of forcing her to have sex. Montague was expelled on Feb. 10, according Stern’s letter.

In the statement, Stern outlined what he claimed as facts not in dispute from the account of the female student. Montague and the woman “developed a relationship that led to them sleeping together in Jack’s room on four occasions in the fall of 2014.”

Stern’s statement says the woman left the room after sex on the fourth occasion but returned later and spent the night with him.

“The sole dispute is as to the sexual intercourse on the fourth occasion,” Stern’s statement says. “She stated that she did not consent to it. He said that she did.”

The statement said the woman reported the incident to a Title IX coordinator on campus a year later and that the coordinator filed a formal complaint with the university.

The University-Wide Committee on Sexual Misconduct ruled against Montague, and Montague’s dean then ordered him to be expelled.

Posters on campus had pictured the Yale basketball team with the words “Stop Supporting a Rapist.” The team had worn shirts with Montague’s No. 4 and the nickname “Gucci” along with “Yale” printed backwards on the front.

Last week, the associate director of Yale sports publicity sent out a statement in part apologizing for the team’s actions.

The New Haven Police Department has said there is no investigation or charges involving Montague.
