Yulia Tymoshenko's Case Goes to the European Court of Justice

Yulia Tymoshenko`s case now will be considered by the European Court of Human Rights. This comes after the Kiev Court of Appeal ratified the Pechersky Court's decision of Tymoshenko's guilt. The former prime minister's lawyers have decided to seek justice in courts outside the country.

The European Court of Human Rights will take up the case of Yulia Tymoshenko.

Her defense appealed to the higher court after the appellate court upheld the verdict of the former prime minister and dismissed her appeal against the decision of the Pechersky district court.

On Friday the Court of Appeal upheld a court decision that found Tymoshenko guilty of abuse of power during the signing of gas contracts with Russia in 2009.

She was sentenced to seven years in prison.

"We believe that at present the only feasible way to protect the rights of Yulia Tymoshenko is to appeal to courts outside of Ukraine, that is, courts that are not controlled by Yanukovych and his team."

According to Sergei Vlasenko, the emphasis will be on protecting Yulia Tymoshenko's application to the European Court of Human Rights.

Vlasenko said that they used the fifth article of the European Human Rights Convention as the basis for the lawsuit and gave several examples that prove the existence of political bias within the Ukrainian court system.

"The Government of Ukraine has been given until March 22 to answer this statement. Then the defense has 4 weeks to submit their comments. After that the matter may be reviewed at any time and at any moment."

Tymoshenko is said to be in poor health.
