    His prison sentence has been scheduled to begin, but a man convicted of a real estate scam says he’s too obese to go.

    James Olivos was found guilty in December and handed a 5-year prison term.

    He was also ordered to pay back almost 3 million dollars.

    Since, he’s made a habit of missing self-surrender deadlines and offering health-related reasons for why he was unable to show.

    In the past he’s claimed his inability to comply has been the result of ADHD, coughing up blood, foot pain, and rectal bleeding.

    Now he’s contending that he simply can’t go to prison because he won’t get the necessary treatment for his obesity problem.

    On all counts, he’s been unable to provide the court with adequate proof.

    Having reached her limit, a magistrate has given him 48 hours to straighten the situation out.

    The only way he will be able to avoid incarceration – and potentially some other charges - is by coming up with documentation that confirms his claims.

    She added that the only thing stopping her from taking him into custody on the spot was that she isn’t the one who initially handed down the sentence.
