Pedophiles rejoice: Texas court rules it's a-okay for adults to sext kids!

A case in Texas involving a one-time teacher who allegedly engaged in sexually explicit chat with a teenager has brought down a 2005 law which made it illegal for salacious material to be transmitted electronically to minors. The law was struck down as unconstitutional on Wednesday in the Texas Court of Appeals, the state's highest court, once again making it lawful for adults to talk dirty to kids.

The case centered on 53-year-old John Christopher Lo, who was arrested in 2010 for sending lurid text messages and pictures to an underage former student of his. Lo's attorney, Mark Bennett, believes his client is in the clear after the court dismissed a pending indictment against the sextin' Texan in its ruling.

The law's opponents say it was written too broadly and could be interpreted to outlaw everything considered sexually suggestive—from a video of Miley Cyrus' performance at this year's MTV Video Music Awards to sexual content in works of Shakespeare. Moreover, they believe the ban should never have made it into law.

In explaining the court's unanimous decision, Judge Cathy Cochran wrote: "In sum, everything (the law) prohibits and punishes is speech and is either already prohibited by other statutes - such as obscenity, disturbing harmful materials to minors, solicitation of a minor, or child pornography - or is constitutionally protected..."

The ruling has divided public opinion. Free speech activists are celebrating the victory while others fear it will let pedophiles groom and pursue youngsters without consequence.

Legal experts say the Supreme Court has never created a category of unprotected speech, but are already flagging an expected challenge to the ruling in that court.
