    He’s filed a lawsuit, identifying both the retailer and the bag manufacturer as the parties ultimately responsible for her passing.

    In the spring of 2010, the man’s wife was leaving a Walmart store with what he says was a faulty, overstuffed pack.

    As she walked through the lot towards her car the tote broke and a 2 and a half pound can fell from it and onto her foot.

    She suffered a deep laceration and a broken toe.

    The cut became infected and neither antibiotics nor surgeries could stop it from spreading.

    Almost one year after the incident in the parking lot, the woman passed away.

    Her widowed husband is going after Walmart for not properly training its employees to bag merchandise and the bag maker for distributing a faulty product.

    656 thousand dollars for her medical expenses is being sought as well as an undisclosed sum to cover funeral and burial expenses as well as the widower’s personal suffering.

    When questioned, a spokesperson from Walmart expressed condolences, but said the company would address the other matters in court.
