Request to the constitutionnal Court in Belgium for the annulation of the Lisbon Treaty Is based up on following arguments;
The Belgian EU Watchers have found out that the Belgian ratification process has not been completed successfully whatever gouvernement members say about this matter is in conflict with the fact that the crucial agreement signed by the King on 17 th of June has not yet been published in the Official journal, last step of the Belgian law making. As a last possibility to oppose the undemocratic behavior of the politiciens not worthy a legal democratic state, they decided to address the Constitutional Court with the following facts:
1. The inéquality between countries in Europe where people could vote by referendum and countries where they could not are in contradiction with the basic human rights of equality and thus subject of the allegation of discrimination.
2. This treaty is fundamentally constitutional and has not been treated as such with a referendum;
3. We face in Belgium a problem of the Nine local parliaments who have the same rights as the federal as it is now. The parliaments planned a special agreement of subsidiarity in between each other before ratification which has until now not yet been accomplished. Ratification by each of these parliaments is illegal in the mean time.
4. The opt outs (individual countries can say we do not agree on parts of the treaty) in the Lisbon treaty are in conflict with the principle of equalities defined by the european charter of Human rights.
All these allegations are well developped with former statements of legal kind.
