With all these scandals piling up (Walter Reed, prosecutor purge, Libby conviction, FBI's NSLs abuses, etc.) Jack wonders if the antiquated notion of "checks and balances" (remember that?!) is making a comeback. "What you have here is a White House that has become an accountability free zone that is now facing the reality of checks and balances from Congress. For six years President Bush got pretty much whatever he wanted from a Republican-controlled rubber stamp Congress that refused to exercise any oversight of the Executive branch of government. Well, mercifully, that party appears to be over." I've said it before and I'll say it again: The Democratic Congressional takeover was the best thing that could have happened to this country. The rubber-stamp GOP'ers would have buried every single one of these scandals and taken the administration at their word. 3/7/07: You can always rely on Cafferty for an appropriate amount of outrage and he didn't let us down yesterday. Jack wants to know who Libby lied to protect, how the conviction will affect President Bush, and what his lies say about the Bush/Cheney White House in general. The conviction of I Lewis "Scooter" Libby, Vice President Dick Cheney's former chief of staff, on criminal charges of obstruction of justice and perjury brings only a partial conclusion to the sordid political tragedy that is the Bush presidency. Yet the judgment on this matter goes to the heart of the administration. The means and the ends of Bush's White House have received a verdict from the bar of justice. Foreign policy was and is the principal way of consolidating unchecked executive power. In the run-up to the Iraq war, professional standards, even within the military and intelligence agencies, were subordinated to political goals. Only information that fit the preconceived case was permitted. Those who advanced facts or raised skeptical questions about sketchy information were seen as deliberate enemies causing damage from within. From the beginning, the White House indulged in unrestrained attacks on such professionals. Dennis Collins, the only jury member to address the media after the verdict, explains how the panel came to their decision, and offered some interesting insight into the deliberation process. Apparently the jury wanted to know where Cheney and Rove were. Hopefully that picture will become clearer as time progresses. [I]n the final analysis, he said jurors found Libby's story just too hard to believe. "It was just very hard to believe how he could remember it on a Tuesday and forget it on a Thursday and then remember it two days later," Collins told reporters outside U.S. District Court. "Having said that, I will say that there was a tremendous amount of sympathy for Mr. Libby on the jury." "It was said a number of times, 'What are we doing with this guy here? Where's [Karl] Rove … where are these other guys?' "We're not saying we didn't think Mr. Libby was guilty of the things we found him guilty of, but it seemed like … he was the fall guy." Prosecutor Patrick Fitzgerald addresses the media after Libby is found guilty on 4 of 5 counts of perjury and obstruction of justice. David Shuster asks about Vice President Cheney's role in the leak and subsequent coverup but doesn't manage to get much new information. Although he said he has no plans of pursuing anything further, Fitz left open the possibility in case new information comes to light. Today's event sends a potent and unmistakable message, one that is absolutely reverberating in the West Wing: If Libby can be convicted of multiple felonies, then any Bush official who has committed crimes can be as well. Not only are Bush officials subject to the rule of law (their radical theories of executive power to the contrary notwithstanding), they are also vulnerable to legal consequences (the defeatist beliefs of some Bush critics notwithstanding). Having the nation watch this powerful Bush official be declared a criminal — despite having been defended by the best legal team money can buy — resoundingly reaffirms the principle that our highest political officials can and must be held accountable when they break the law.
