Senators Durbin and Specter were on Meet the Press yesterday to talk about the purge scandal and, to his credit, Tim Russert hammered home the newest revelations and put the big picture into context. Durbin was spot on as well. Specter's role in this scandal has flown under the radar and it's this area where Tim missed a crucial opportunity to put him in the hot seat. It was a staffer of Specter's that slipped the controversial provision into the Patriot Act that the White House was planning on taking advantage of. Senator Specter has a long history of being a gutless worm and should be exposed as such. His middle-of-the-road, "benefit of the doubt" attitude has abetted this administration's myriad crimes for far too long. I don't expect him to be a shrill partisan, but Gonzales and the White House have given us no reason to believe anything they say and should be treated with a great deal of skepticism. So sayeth John McKay, one of the fired USAs in the US Attorney/Alberto Gonzales scandal on Meet the Press this morning. MR. McKAY: Well, we really don’t—it tells me that, that the Justice Department and, and the administration and the President have a responsibility now to deal with the black cloud that’s hanging over the Department of Justice. The—our former colleagues who were United States attorneys and the career men and women who do the work of the Department of Justice are…are people of great integrity. The last thing they need to deal with is an implication that politics are allowed into the grand jury. 3/18/07 On Face the Nation, Senator Feinstein told Bob Scheiffer she has evidence that U.S. attorney Carol Lam was pinpointed for firing after she notified the Justice Department she was issuing search warrants for a Republican corruption case. According to Feinstein, an email was sent from the DoJ to the White House shortly after this notification saying that there was a "real problem we have right now with Carol Lam." This is why the White House and Alberto Gonzales are in hot water. The evidence is becoming clearer by the day that these attorneys were cherry-picked for replacement because they wouldn't politicize their positions and sacrifice their independence; not because of the supposed "performance-related" issues. Sen. Schumer: “We do have evidence” Gonzales lied under oath During his January 18, 2006 testimony before the Senate Judiciary Committee, Alberto Gonzales said this: GONZALES: I would never, ever make a change in a United States attorney position for political reasons or if it would, in any way, jeopardize an ongoing serious investigation. I just would not do it. When asked on Meet the Press this morning if he "had any evidence that a U.S. attorney was removed and that removal jeopardized an ongoing investigation," Senator Schumer said he does and that the evidence is "becoming more and more overwhelming." This is why the prosecutor purge is a genuine scandal. Not only is there clear evidence that the firings were unprecedented and purely politically-motivated, but Alberto Gonzales lied about it under oath and the White House keeps changing it's story. What conclusion can we draw from these lies and revisionisms other than they have something to hide? Namely, that these eight prosecutors were selectively fired because they did not sufficiently politicize their offices and succumb to pressure to do so, only later to be fired for "performance-related" reasons despite receiving exemplary evaluations. As if the prosecutorial purge scandal wasn't enough, Alberto Gonzalez will be called to answer even more questions about his role in blocking an investigation into the warrantless wiretapping program. Keith provides some context. CBS is reporting Gonzales' days are numbered. How can he possibly survive this? And how long until we hear the "Clinton did it too!" defense? Last July, it was revealed that the Office of Professional Responsibility in the Justice Department — the office "responsible for investigating allegations of misconduct involving Department attorneys" — repeatedly attempted to investigate whether DOJ lawyers acted improperly concerning their role in the President's warrantless eavesdropping program, but finally stopped their investigation because the President refused to give them the security clearances they needed to conduct the investigation. Yesterday, Murray Waas reported in National Journal that it was Alberto Gonzales who advised the President to deny those clearances even after Gonzales "learned that his own conduct would likely be a focus of the investigation." The investigation which they blocked "would have examined Gonzales's role in authorizing the eavesdropping program while he was White House counsel, as well as his subsequent oversight of the program as attorney general." Using the recently-disclosed internal White House/DoJ emails, Keith connects the dots and produces a cohesive narrative that shows how intimately involved the White House was in the politically-motivated purge of insufficiently loyal and partisan USAs. In its fumbling attempts to explain the purge of United States attorneys, the Bush administration has argued that the fired prosecutors were not aggressive enough about addressing voter fraud. It is a phony argument; there is no evidence that any of them ignored real instances of voter fraud. But more than that, it is a window on what may be a major reason for some of the firings. The United States attorney purge appears to have been prompted by an array of improper political motives. Carol Lam, the San Diego attorney, seems to have been fired to stop her from continuing an investigation that put Republican officials and campaign contributors at risk. These charges, like the accusation that Mr. McKay and other United States attorneys were insufficiently aggressive about voter fraud, are a way of saying, without actually saying, that they would not use their offices to help Republicans win elections. After ABC News broke the story that new e-mails have surfaced that place Karl Rove at the center of the purge scandal, Senator Schumer addressed the media to discuss where the road goes from here. Now it's clear Karl Rove was involved. So statements from the White House press office and from others involved have proved to be false, false, false time after time after time." Senate Judiciary Republicans stalled a vote today on whether or not to issue subpoenas to White House officials (i.e. Karl Rove) while WH Counsel Fred Fielding tries to strike a deal that would keep Rove out of the hot seat. If the White House claims privilege and Rove defies subpoena, we could face a serious Constitutional showdown. Jack Cafferty became giddy today at the prospect of an under oath showdown between Senator Leahy and Karl Rove. My money's on Leahy. Inconsistent, incompetent and exaggerated reporting of terrorist threats? Whodathunk it? Keith Olbermann covers it on Countdown: Nearly all of the terrorism-related statistics reported by the US Justice Department and the FBI from the September 11 attacks until early 2005 had some inaccuracies, the department's inspector general has said. The findings drew immediate criticism from US senators, who said it raised serious doubts over how effectively the administration was fighting the terrorism threat. [..]The report found that only two out of 26 statistics were accurate after reviewing the number of terrorism convictions in the 2003 and 2004 financial years, the number of convictions or guilty pleas from September 11, 2001, through February 3, 2005, and the number of terrorist threats tracked by the FBI in 2003 and 2004. "We found many cases involving offenses such as immigration violations, marriage fraud, or drug trafficking where department officials provided no evidence to link the subject of the case to terrorist activity," the report said. And this man is the Attorney General. Specter: Now wait a minute, wait a minute. The Constitution says you can't take it away except in the case of invasion or rebellion. Doesn't that mean you have the right of habeas corpus? Gonzales: I meant by that comment that the Constitution doesn't say that every individual in the United States or every citizen has or is assured the right of habeas corpus. It doesn't say that.
