<br />The Russell Tribunal on Palestine seeks to reaffirm the primacy of international law as the basis for the settlement of the Israeli-Palestinian conflict. It will build its work around the enunciation of law by authoritative bodies. The International Court of Justice in its Opinion on the Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory, has analysed the relevant provisions of International Humanitarian Law and International Law of Human Rights and the dozens of international resolutions concerning Palestine. It is for this tribunal to address the failure of the application of the law even though it has been so clearly identified. Our work starts where the opinion of the ICJ stopped: highlighting the responsibilities arising from the enunciation of law, including the responsibilities of the international community. The latter can not continue to shirk its obligations. <br /><br />Le Tribunal Russell sur la Palestine vise à réaffirmer la primauté du droit international comme base du règlement du conflit israélo-palestinien. Il s’appuiera dans son travail sur l’énonciation du droit par des instances faisant autorité. La Cour Internationale de Justice, dans son avis sur les conséquences juridiques de l'édification d'un mur dans le territoire palestinien occupé, a ainsi analysé les dispositions pertinentes du Droit International Humanitaire et du Droit International des Droits de l'Homme ainsi que les dizaines de résolutions internationales concernant la Palestine. Il s'agit pour ce tribunal de se pencher sur l'inapplication du droit alors même qu'il a été si clairement identifié. Notre entreprise commence là où l'avis de la CIJ s'est arrêté : souligner les responsabilités découlant de l'énonciation du droit, notamment les responsabilités de la communauté internationale. Cette dernière ne peut continuer à fuir ses obligations.
